принимая во внимание Договор о создании Европейского сообщества, в частности статью 100a,
принимая во внимание предложение Европейской комиссии <*>,

действуя в соответствии с порядком, установленным статьей 189b Договора о создании Европейского сообщества,
принимая во внимание следующие обстоятельства:
государства-члены ЕС имеют обязательства по обеспечению защиты на территориях своих стран безопасности и здоровья людей, по возможности - домашних животных, имущества, в частности, здоровья и безопасности работников в особенности от рисков, связанных с применением оборудования и систем, обеспечивающих защиту от потенциально взрывоопасных атмосфер;
существуют обязательные положения, определяющие в государствах-членах ЕС уровень безопасности, который должен обеспечиваться защитным оборудованием и системами, предназначенными для применения в потенциально взрывоопасных атмосферах, в частности, техническими условиями на применение электротехнических и неэлектротехнических средств, которые могут использоваться в потенциально взрывоопасных атмосферах;
требования, которым должно соответствовать подобное оборудование, отличаются в государствах-членах ЕС по объему, процедурам контроля, что может создавать торговые проблемы в рамках Сообщества;
унификация национальных законодательных актов является единственным средством по устранению таких проблем в свободной торговле. Данная цель не может быть достигнута отдельно взятыми государствами-членами ЕС. Настоящая Директива устанавливает требования свободного перемещения оборудования и систем, о которых идет речь;
существует необходимость установления правил, предусматривающих устранение технических препятствий торговле, в соответствии с новым подходом, изложенным в Решении Совета ЕС от 7 мая 1985 г. <*>, которое констатирует необходимость определения основных требований безопасности и других общественных требований без понижения существующих обоснованных уровней защиты в государствах-членах ЕС. Это Решение предусматривает распространение единой Директивы на значительное количество изделий во избежание частого внесения в нее изменений и увеличения количества Директив;

существующие Директивы по сближению законодательств государств-членов ЕС в области электрооборудования, предназначенного для использования в потенциально взрывоопасных атмосферах, привели бы к положительным сдвигам в защите от взрывов в связи с усовершенствованием вновь выпускаемого оборудования и способствовали бы устранению торговых барьеров в этой области. Существует необходимость одновременных ревизии и расширения области применения действующих Директив, особенно в общем контексте - принятия мер против потенциальных рисков, связанных с применением подобного оборудования. Это, в частности, предполагает, что меры, предназначенные для гарантии эффективной защиты пользователей и третьих сторон, должны предусматриваться уже на стадиях проектирования и производства.
виды рисков, защитные меры и методы тестирования зачастую очень похожи, если не идентичны, как для горнодобывающего оборудования, так и оборудования для открытых работ. Представляется необходимым распространить действие единой Директивы на защитное оборудование и системы этих групп;
указанные выше две группы оборудования используются во многих производственных и промышленных отраслях и имеют большое экономическое значение;
соответствие основным требованиям к обеспечению безопасности и здоровья существенно для обеспечения безопасности защитного оборудования и систем. Эти требования подразделяются на общие и дополнительные, которым должно соответствовать защитное оборудование и системы. Дополнительные требования предназначены для того, чтобы учесть существующие или потенциальные опасности. Защитные системы и оборудование должны соответствовать не менее чем одному из этих требований, если это необходимо для их надлежащего функционирования или для применения по назначению. Понятие "применение по назначению" имеет первостепенное значение для испытаний свойств взрывоопасности защитного оборудования и систем. Изготовителям важно предоставлять полную информацию и четко использовать маркировку указанного оборудования, указывающую на его использование в потенциально взрывоопасных атмосферах;
имеется намерение подготовить Директиву по действиям в потенциально взрывоопасных атмосферах на основе статьи 118a. Дополнительная Директива будет, в частности, распространяться на взрывоопасность, возникающую в результате конкретного использования и/или методов монтажа;
соответствие основным требованиям к обеспечению здоровья и безопасности людей является обязательным при оценке безопасности оборудования. Окончательная оценка должна происходить при реализации этих требований, позволяющей учесть как технологию при производстве, так и основные технические и экономические требования;
данная Директива устанавливает только основные требования. Для облегчения оценки соответствия основным требованиям необходимы унифицированные европейские стандарты, особенно в отношении неэлектрической защиты от взрывов, то есть стандарты проектирования, производства и испытания оборудования, соответствие которым позволяет считать, что изделие отвечает установленным основным требованиям. Унифицированные европейские стандарты разрабатываются частными организациями и должны сохранять необязательный статус. В этой связи Европейский комитет по стандартизации (CEN) и Европейский комитет по стандартизации в области электротехники (Cenelec) признаны компетентными организациями для принятия унифицированных стандартов в соответствии с общими основными принципами по взаимодействию Европейской комиссии с этими двумя организациями, подписанными 13 ноября 1984 г. В соответствии с целями данной Директивы унифицированным стандартом является техническая спецификация (Европейский стандарт или унифицирующий документ), принятая какой-либо из этих организаций в соответствии с инструкцией Европейской комиссии, согласованной с положениями Директивы Совета ЕС 83/189/ЕЭС от 28 марта 1983 г. и устанавливающей процедуру предоставления информации в области технических стандартов и регламентов <*> и соответствующей упомянутым выше общим принципам;

существует необходимость совершенствования законодательной базы с учетом эффективного участия служащих и рабочих в процессе стандартизации для завершения работы над законодательной базой к моменту введения в действие этой Директивы;
с точки зрения характера рисков, связанных с эксплуатацией оборудования в потенциально взрывоопасных атмосферах, необходимо определить процедуры оценки соответствия основным требованиям Директив. Эти процедуры должны разрабатываться с учетом уровня риска, который может быть характерен для оборудования, и/или от которого системы должны защищать непосредственное окружение. Каждая категория оценки соответствия оборудования должна дополняться соответствующей процедурой или выбором между аналогичными процедурами. Принятые процедуры полностью соответствуют Решению Совета ЕС 93/465/ЕЭС от 22 июля 1993 г. по модулям различных этапов процедур оценки соответствия, которые предполагается использовать в Директивах по технической унификации <*>;

совет ЕС предусмотрел маркировку изделия изготовителем или его уполномоченным представителем в рамках Сообщества. Маркировка означает, что изделие соответствует всем основным требованиям и процедурам оценки, предусмотренным законодательством Сообщества, применяемым к данному изделию;
государства-члены ЕС в соответствии со статьей 100a Договора могут принимать меры по ограничению или запрещению поставки на рынок или эксплуатации оборудования и защитных систем, если они представляют конкретный риск для безопасности людей и, возможно, животных или имущества, при условии, что такие меры подлежат процедуре проверки со стороны Сообщества;
страны, получившие любое решение, принятое во исполнение настоящей Директивы, должны знать о причинах принятия такого решения и иметь возможность его опротестовать;
18 декабря 1985 г. Совет ЕС принял основополагающую Директиву по электрооборудованию при его эксплуатации в потенциально взрывоопасных атмосферах (76/117/ЕЭС) <*> и 15 февраля 1982 г. Директиву по электрооборудованию при его эксплуатации в потенциально взрывоопасных атмосферах в шахтах с угрозой возгорания газа (82/130/ЕЭС) <**>. Переход от добровольной и частичной унификации к всеобщей, на принципах которой основаны настоящие Директивы, рассматривался с самого начала процесса унификации. Сфера применения настоящей Директивы полностью охватывает сферу применения всех вышеуказанных Директив, в связи, с чем последние должны быть отменены;

международный рынок объединяет территории государств-членов ЕС без внутренних границ, что обеспечивает свободное движение товаров, людей, услуг и капитала;
необходимо обеспечить транзит оборудования и систем в соответствии с национальным законодательством,
приняли настоящую Директиву:
Глава I. ОБЛАСТЬ ПРИМЕНЕНИЯ, ПОСТАВКА НА РЫНОК
И СВОБОДА ПЕРЕМЕЩЕНИЯ
Статья 1
1. Сфера применения настоящей Директивы распространяется на оборудование и защитные системы, предназначенные для применения в потенциально взрывоопасных атмосферах.
2. Сфера применения настоящей Директивы также распространяется на предохранительные, управляющие и регулирующие устройства, предназначенные для использования за пределами взрывоопасных атмосфер: устройства, которые также необходимы для безопасного функционирования оборудования во избежание рисков взрыва (исчерпывающий перечень указан в Директиве).
3. В настоящей Директиве используются следующие понятия:
Оборудование и защитные системы, предназначенные для использования в потенциально взрывоопасных атмосферах.
a) "Оборудование" означает машины, аппараты, стационарные или передвижные устройства, элементы их систем управления, контрольно-измерительные приборы и системы обнаружения или предупреждения, которые совместно или раздельно предназначаются для выработки, передачи, хранения, измерения, контроля и преобразования энергии и/или обработки материалов и которые могут являться причиной взрыва из-за собственных потенциальных источников воспламенения.
b) "Защитные системы" означают приборы, устройства, отличные от компонентов вышеуказанного оборудования, которые предназначены для незамедлительной остановки предполагаемых взрывов и/или ограничения поражающей площади взрыва и которые поставляются на рынок отдельно в качестве автономных систем.
c) "Компоненты" означают любые изделия, необходимые для безопасного функционирования оборудования и защитных систем, но не работающие автономно.
Взрывоопасные атмосферы.
Смесь горючих веществ в форме газов, паров, тумана или пыли с воздухом в атмосферных условиях, в которых возгорание после воспламенения распространяется на всю несгоревшую смесь.
Потенциально взрывоопасная атмосфера.
Атмосфера, которая может стать взрывоопасной при локальных или рабочих условиях.
Группы и категории оборудования.
Группа оборудования I включает оборудование, предназначенное для применения на подземных участках шахт, и те части наземных установок шахт, которые могут подвергаться опасности при наличии рудничного газа и/или горючей пыли.
Группа оборудования II включает оборудование, предназначенное для использования в других местах, подверженных опасности воздействия взрывоопасных атмосфер.
Категории оборудования и соответствующие необходимые уровни защиты описаны в Приложении I.
Оборудование и защитные системы необходимо разрабатывать для каждого вида взрывоопасной атмосферы. При этом они должны иметь соответствующую маркировку.
Для безопасности использования оборудования, защитных систем и устройств, указанных в пункте 2 статьи 1 в соответствии с группой и категорией, необходима также информация изготовителя.
4. Из сферы применения настоящей Директивы исключены:
- приборы, использующиеся в медицинских целях;
- оборудование и защитные системы, для которых опасность взрыва возникает только при наличии взрывоопасных и нестойких химических веществ;
- оборудование, предназначенное для бытового и непроизводственного применения, при использовании которого взрывоопасные атмосферы образуются в редких случаях и только при случайной утечке топливного газа;
- индивидуальные средства защиты, на которые распространяется действие Директивы 89/686/ЕЭС <*>;

- морские суда и передвижные морские платформы вместе с оборудованием на борту таких судов и платформ;
- транспортные и прицепные средства, предназначенные исключительно для перевозки пассажиров по воздуху, автодороге, железной дороге или водным путем, а также транспортные средства, предназначенные для транспортировки грузов по воздуху, автодороге, железной дороге или водным путем. Транспортные средства, предназначенные для применения в потенциально взрывоопасной атмосфере, не исключаются из сферы применения Директивы;
- оборудование, на которое распространяется действие статьи 223 (1) "b" Договора.
Статья 2
1. Государства-члены ЕС должны принимать все необходимые меры, обеспечивающие поставку на рынок и ввод в эксплуатацию оборудования, защитных систем и устройств, определенных в статье 1 (2) настоящей Директивы, при условии, что они при надлежащей установке, обслуживании и целевом применении не создадут угрозы для здоровья, безопасности людей и, при необходимости, домашних животных и имущества.
2. Положения настоящей Директивы не должны ущемлять права государств-членов ЕС при должном соблюдении положений Договора и обеспечении защиты людей, в частности, рабочих при эксплуатации оборудования, защитных систем и устройств, перечисленных в статье 1 (2); это не означает, что такое оборудование, системы или устройства могут изменяться способами, не указанными в Директиве.
3. Государства-члены ЕС не должны препятствовать демонстрации на торговых ярмарках, выставках и т.п. оборудования, защитных систем или устройств, указанных в статье 1 (2), которые не соответствуют положениям настоящей Директивы, при условии наличия видимого обозначения, что такое оборудование, защитные системы или устройства, указанные в статье 1 (2), не отвечают требованиям настоящей Директивы и не предназначены для продажи до тех пор, пока они не будут приведены в соответствие изготовителем или его законным представителем, зарегистрированным в Сообществе. Во время демонстрации необходимо принимать меры по обеспечению безопасности людей.
Статья 3
Оборудование, защитные системы и устройства, перечисленные в статье 1 (2) настоящей Директивы, должны соответствовать основным требованиям безопасности жизни и здоровья, указанным в Приложении II, при их использовании по назначению.
Статья 4
1. Государства-члены ЕС не должны запрещать, ограничивать или препятствовать поставке на рынок и вводу в эксплуатацию на их территориях оборудования, защитных систем или устройств, определенных статьей 1 (2), которые отвечают требованиям Директивы.
2. Государства-члены ЕС не должны запрещать, ограничивать или препятствовать поставке на рынок компонентов, сопровождающихся письменным подтверждением соответствия, определенным в статье 8 (3), которые включаются в оборудование и защитные системы, указанные в Директиве.
Статья 5
1. Государства-члены ЕС должны рассматривать отвечающие всем положениям настоящей Директивы, включая соответствующие процедуры, оценки соответствия, установленные главой II:
- оборудование, защитные системы и устройства, определенные в статье 1 (2), с декларацией ЕС о соответствии, указанной в Приложении X, и с маркировкой CE в соответствии с положениями статьи 10;
- компоненты, указанные в статье 4 (2), при наличии сертификата соответствия (статья 8 (3)).
При отсутствии унифицированных стандартов государства-члены ЕС должны предпринимать необходимые меры по доведению информации до всех заинтересованных сторон о действующих национальных стандартах и спецификациях, которые являются важными или подходящими для выполнения основных требований по обеспечению здоровья и безопасности (Приложение II).
2. Если национальный стандарт, введенный на основе унифицированного стандарта, опубликованного в Официальном журнале Европейских сообществ, включает одно или большее число основных требований к обеспечению здоровья и безопасности, то оборудование, защитные системы и устройства, упомянутые в статье 1 (2), или компоненты, указанные в статье 4 (2) и изготовленные в соответствии с требованиями данного стандарта, должны считаться соответствующими основным требованиям по обеспечению здоровья и безопасности.
Государства-члены ЕС должны публиковать ссылки на национальные стандарты, разработанные на основе унифицированных стандартов.
3. Государства-члены ЕС должны принимать соответствующие меры, позволяющие партнерам участвовать в разработке и мониторинге унифицированных стандартов на национальном уровне.
Статья 6
1. Если государство-член ЕС или Европейская комиссия считает, что унифицированные стандарты, установленные статьей 5 (2), не полностью соответствуют основным требованиям обеспечения здоровья и безопасности, определенным статьей 3, Европейская комиссия или заинтересованное государство-член ЕС должны вынести вопрос на рассмотрение Комитета, созданного в соответствии с Директивой 83/189/ЕЭС (в дальнейшем - "Комитет"), и представить необходимые обоснования. Комитету необходимо вынести заключение в кратчайшие сроки.
С учетом заключения Комитета Европейской комиссии следует информировать государства-члены ЕС независимо от необходимости аннулирования каких-либо из стандартов, указанных в статье 5 (2).
2. Европейская комиссия может принять любые необходимые меры для обеспечения практического исполнения настоящей Директивы в соответствии с процедурой, описанной в параграфе 3.
3. Европейской комиссии будет оказывать помощь Постоянный комитет (далее - "Комитет").
При ссылке на указанный параграф, следует применять статьи 3 и 7 Решения 1999/468/ЕС <*>, принимая во внимание положения статьи 8.

Комитету необходимо установить свои процедурные правила.
4. Постоянный комитет может рассматривать любой вопрос, относящийся к применению настоящей Директивы, представленный на рассмотрение его председателем, либо по его инициативе или по просьбе государства-члена ЕС.
Статья 7
1. Если государство-член ЕС подтверждает, что оборудование, защитные системы или устройства, указанные в статье 1 (2), маркированные знаком соответствия CE и эксплуатируемые в соответствии с их назначением, могут представлять опасность для людей, возможно - домашних животных или имущества, оно должно принять необходимые меры для изъятия такого оборудования или защитных систем с рынка, запрещения их поставки, ввода в эксплуатацию или ограничения свободного перемещения.
Государство-член ЕС должно незамедлительно проинформировать Европейскую комиссию о любых принятых мерах, указав причину принятого решения, в частности, из-за:
a) несоответствия основным требованиям, указанным в статье 3;
b) неправильного применения стандартов, указанных в статье 5 (2),
c) недостатков стандартов, определенных в статье 5 (2).
2. Европейская комиссия должна незамедлительно провести консультации с заинтересованными сторонами. Если после проведенных консультаций Европейская комиссия считает принятые меры обоснованными, она должна в кратчайшие сроки проинформировать государство-член ЕС, инициировавшее данные меры, а также другие государства-члены ЕС. Если Европейская комиссия посчитает принятую меру необоснованной, она незамедлительно должна проинформировать инициатора и изготовителя или его законного представителя. Если решение, на которое сделана ссылка в параграфе 1, основано на недостатках стандартов и если государство-член ЕС, принявшее первоначальное решение, настаивает на своем решении, Европейская комиссия незамедлительно должна проинформировать об этом Комитет для выполнения процедур, предусмотренных статьей 6 (1).
3. Если оборудование, защитная система или устройство, определенные в статье 1 (2), которые не отвечают требованиям, имеют маркировку CE о соответствии, государство-член ЕС предпринимает соответствующие меры в отношении лиц, которые нанесли эту маркировку и информирует об этом Европейскую комиссию и другие государства-члены ЕС.
4. Европейская комиссия должна убедиться, что государства-члены ЕС информированы о ходе и результатах процедуры.
Глава II. ПРОЦЕДУРЫ ОЦЕНКИ СООТВЕТСТВИЯ
Статья 8
1. Процедуры оценки соответствия, включая, при необходимости, устройства, описанные в статье 1 (2), должны быть следующими:
a) оборудование групп I и II, категорий M 1 и 1
Изготовитель или его законный представитель, зарегистрированный в Сообществе, при нанесении знака CE должны руководствоваться процедурой испытания CE типового образца (Приложение III) в сочетании с:
- процедурой определения качества производства (Приложение IV), или
- процедурой определения гарантии качества продукции (Приложение V);
b) оборудование групп I и II, категорий M 2 и 2
i) если к этим группам и категориям относятся двигатели внутреннего сгорания и электрооборудование, изготовитель или его законный представитель, зарегистрированный в Сообществе, должны при использовании знака CE проводить типовую процедуру испытания CE (Приложение III) в сочетании с:
- процедурой соответствия основному образцу (Приложение VI), или
- процедурой соответствия качества продукции (Приложение VII);
ii) если к этим группам и категориям относится другое оборудование, изготовитель или его законный представитель, зарегистрированный в Сообществе, должны при нанесении маркировки CE руководствоваться процедурой внутреннего производственного контроля (Приложение VIII) и представить техническую документацию, предусмотренную параграфом 3 Приложения VIII, уполномоченному органу, который должен в кратчайшие сроки подтвердить ее получение и хранить ее у себя;
c) оборудование группы II, категории 3
Изготовитель или его законный представитель, зарегистрированный в Сообществе, должны при нанесении маркировки CE руководствоваться процедурой внутреннего производственного контроля (Приложение VIII);
d) оборудование групп I и II
Помимо процедур, указанных в параграфе 1 "a", "b" и "c", изготовитель или его законный представитель, зарегистрированный в Сообществе, могут также при проставлении маркировки CE руководствоваться процедурой единичной проверки CE (Приложение IX).
2. Положения 1 "a" или 1 "d", указанные выше, должны использоваться для оценки соответствия автономных защитных систем.
3. Процедуры, описанные в параграфе 1, применяются к компонентам, определенным в статье 4 (2), за исключением нанесения маркировки CE. Письменное подтверждение должно составляться изготовителем или его законным представителем, зарегистрированным в Сообществе, который заявляет о соответствии компонентов положениям Директивы, относящихся к ним, а также указывает их характеристики и метод их комплектации в оборудовании или защитных системах с целью обеспечения соответствия основным требованиям, применительно к готовому оборудованию. Процедуры, указанные в параграфе 1, должны применяться к компонентам и защитным системам.
4. Кроме того, изготовитель или его законный представитель, зарегистрированный в Сообществе, может для проставления маркировки CE следовать процедуре, относящейся к внутреннему производственному контролю (Приложение VIII) с учетом требований безопасности (пункт 1.2.7 Приложения II).
5. Тем не менее, компетентные организации при наличии обоснованного запроса дают разрешение на поставку на рынок и использование на территории государств-членов ЕС указанного оборудования, защитных систем и устройств, упомянутых в статье 1 (2), даже без применения процедур, указанных в предыдущих параграфах, но использующихся в защитных целях.
6. Документы и переписка, относящиеся к вышеупомянутым процедурам, должны вестись на одном из официальных языков государств-членов ЕС, либо на языке уполномоченного органа.
7. a) Если оборудование, защитные системы и устройства, указанные в статье 1 (2), попадают в сферу применения других Директив Сообщества, которые касаются иных вопросов, связанных с маркировкой CE (статья 10), маркировка должна указывать, что оборудование и защитные системы соответствуют положениям этих Директив.
b) Если одна или более Директив позволяет изготовителю выбрать, какую систему применять на данный момент, маркировка CE должна указывать, какие Директивы им применяются. В этом случае реквизиты этих Директив, опубликованные в Официальном журнале Европейских сообществ, должны приводиться в документах, уведомлениях или инструкциях, сопровождающих оборудование, защитные системы и устройства, указанные в статье 1 (2).
Статья 9
1. Государства-члены ЕС должны уведомлять Европейскую комиссию и остальные государства-члены ЕС об органах, на которые возложены обязанности проведения процедур, указанных в статье 8, и о конкретных задачах, поставленных перед этими органами, а также об идентификационных номерах, присвоенных им Европейской комиссией. Европейская комиссия должна опубликовать в Официальном журнале Европейских сообществ список уполномоченных организаций с указанием их идентификационных номеров и задач, решение которых находится в их компетенции. Европейская комиссия должна обеспечить регулярное обновление этого списка.
2. Государства-члены ЕС должны применять критерии оценки, установленные в Приложении XI, при определении компетенции уполномоченных органов. Органы, соответствующие данным критериям и унифицированным стандартам, считаются компетентными.
3. Государство-член ЕС, утвердившее орган, должно прекратить его полномочия, если будет установлено, что этот орган перестал соответствовать критериям, определенным Приложением XI. Государство-член ЕС должно незамедлительно информировать об этом Европейскую комиссию и остальные государства-члены ЕС.
Глава III. МАРКИРОВКА СООТВЕТСТВИЯ CE
Статья 10
1. Маркировка соответствия CE должна состоять из заглавных букв "CE". Рекомендуемый образец маркировки представлен в Приложении X. За маркировкой CE должен следовать идентификационный номер уполномоченного органа, когда последний привлекается на этапе производственного контроля.
2. Маркировка CE должна наноситься отчетливо, различимо визуально, разборчиво и неудолимо с оборудования, защитных систем и устройств, указанных в статье 1 (2), и в соответствии с пунктом 1.0.5 Приложения II.
3. Нанесение маркировки на оборудование, защитные системы или устройства, указанные в статье 1 (2), могущей ввести в заблуждение третьи стороны в отношении значения и формы маркировки CE, должны быть запрещены. Любая другая маркировка, наносимая на оборудование, защитные системы или устройства, указанные в статье 1 (2), должны полностью соответствовать требованиям, предъявляемым к маркировке CE.
Статья 11
Без ущерба действию статьи 7:
a) если государство-член ЕС устанавливает, что маркировка CE нанесена неправильно, изготовитель либо его законный представитель, зарегистрированный в Сообществе, должны привести произведенную продукцию в соответствие с требованиями к маркировке CE и исправить нарушения с учетом условий, поставленных государством-членом СЕ;
b) если нарушения не прекращаются, государство-член ЕС принимает необходимые меры для ограничения или запрещения поставки продукции на рынок или изъятия ее с рынка в соответствии с процедурой, установленной статьей 7.
Глава IV. ЗАКЛЮЧИТЕЛЬНЫЕ ПОЛОЖЕНИЯ
Статья 12
Любое решение, принятое согласно настоящей Директиве, которое ограничивает либо запрещает поставку на рынок и/или ввод в эксплуатацию, запрет на использование оборудования, защитных систем или устройств, указанных в статье 1 (2), должно быть обоснованным. Подобное решение должно доводиться до сведения заинтересованной стороны одновременно с информацией о возможностях защиты со стороны законодательства соответствующего государства-члена ЕС, а также о сроках обжалования.
Статья 13
Государства-члены ЕС должны принимать меры, чтобы все стороны, на которые распространяется применение Директивы, соблюдали конфиденциальность в отношении всей информации, полученной в ходе выполнения своих функций. Это положение не распространяется на обязательства государств-членов ЕС и уполномоченных органов, связанные с обменом информацией и направлением предупреждений.
Статья 14
1. Директива 76/117/ЕЭС, Директива 79/196/ЕЭС <*> и Директива 82/130/ЕЭС будут отменены с 1 июля 2003 года.

2. Сертификаты соответствия унифицированным стандартам ЕС, полученные в результате процедур, установленных Директивами в параграфе 1, действительны до 30 июля 2003 года, если срок их действия не истекает до этого времени. В ином случае их срок действия продлевается в соответствии с положениями об унифицированных стандартах вышеуказанных Директив.
3. Государства-члены ЕС должны принять необходимые меры для того, чтобы уполномоченные органы, ответственные (статья 8 (1) - (4)) за определение соответствия электрооборудования, поставленного на рынок до 1 июля 2003 года, учитывали результаты тестирования и оценки соответствия, установленные Директивами, указанными в параграфе 1.
Статья 15
1. Государства-члены ЕС должны принять и опубликовать нормативные акты, правила и положения, необходимые для обеспечения соответствия настоящей Директиве до 1 сентября 1995 года и информировать об этом Европейскую комиссию.
Государства-члены ЕС должны обеспечить действенное исполнение принятых мер с 1 марта 1996 года.
При выполнении мер, указанных в пункте 1, необходима ссылка на настоящую Директиву или дату официальной публикации. Способы подобных ссылок устанавливаются государствами-членами ЕС.
2. Государства-члены ЕС при этом должны допускать поставку на рынок и ввод в эксплуатацию оборудования и защитных систем, соответствующих их законодательству, с даты утверждения настоящей Директивы до 30 июня 2003 года.
Статья 16
Настоящая Директива адресована государствам-членам ЕС.
Приложение I
КРИТЕРИИ, ОПРЕДЕЛЯЮЩИЕ КЛАССИФИКАЦИЮ ГРУПП
ОБОРУДОВАНИЯ ПО КАТЕГОРИЯМ
1. Группа оборудования I
a) Категория M 1 включает оборудование, разработанное и, при необходимости, оснащенное дополнительными средствами защиты в соответствии с технологическими параметрами изготовителя, обеспечивающими очень высокий уровень безопасности.
Оборудование данной категории предназначено для применения в подземных участках шахт, а также включает части наземных установок, которые подвергаются опасности воздействия рудничного газа и/или горючей пыли.
Оборудование данной категории должно оставаться работоспособным даже при случайном сбое при наличии взрывоопасной атмосферы и обладать следующими ступенями защиты:
- при отказе одного средства защиты необходимый уровень безопасности обеспечивается, по меньшей мере, вторым независимым средством защиты;
- необходимый уровень защиты обеспечивается при отказе двух систем, функционирующих независимо.
Оборудование данной категории должно соответствовать дополнительным требованиям, указанным в Приложении II, 2.0.1.
b) Категория M 2 включает оборудование, рассчитанное на возможность функционирования в соответствии с параметрами, установленными изготовителем, и обеспечивающее высокий уровень защиты.
Оборудование этой категории предназначено для применения в подземных участках шахт и тех наземных участках, которые возможно могут подвергнуться опасности при воздействии рудничного газа и/или горючей пыли.
Данное оборудование должно быть обесточено при условии взрывоопасности атмосферы.
Средства защиты оборудования данной категории обеспечивают необходимый уровень безопасности в процессе эксплуатации, в том числе, при возникновении нештатных ситуаций (небрежного использования), которые могут повлиять на окружающую среду.
Оборудование данной категории должно соответствовать дополнительным требованиям Приложения II, 2.0.2.
2. Группа оборудования II
a) Категория 1 включает оборудование, рассчитанное на работу в соответствии с параметрами изготовителя, обеспечивающими высокий уровень безопасности. Оборудование этой категории предназначено для использования во взрывоопасных атмосферах, возникающих при соединении воздуха и газа испарений смесей пыли и воздуха и постоянного или длительного и/или периодического существования таких соединений.
Оборудование этой категории должно обеспечивать необходимый уровень защиты в случае неполадок систем. Уровень защиты должен соответствовать следующим условиям:
- при отказе одного из средств защиты безопасность обеспечивается, по меньшей мере, другим, работающим автономно;
- безопасность обеспечивается даже при выходе из строя двух систем защиты, работающих автономно.
Оборудование данной категории должно отвечать дополнительным требованиям, указанным в Приложении II, 2.1.
b) Категория 2 включает оборудование, рассчитанное на функционирование в соответствии с рабочими параметрами изготовителя при обеспечении необходимых условий безопасности.
Оборудование предназначено для использования на участках местности, где вероятно возникновение взрывоопасной атмосферы, создаваемой газами, туманом или смесями воздуха и пыли.
Средства защиты такого оборудования обеспечивают необходимый уровень безопасности при предсказуемых частых неполадках или отказах оборудования.
Оборудование данной категории должно соответствовать требованиям Приложения II, 2.2.
c) Категория 3 включает оборудование, рассчитанное на функционирование в соответствии с параметрами изготовителя при обеспечении необходимого уровня безопасности.
Оборудование данной категории предназначено для применения на участках с малой вероятностью возникновения взрывоопасной атмосферы, создаваемой газами, парами, туманами или смесями воздуха и пыли, возникающих нерегулярно и на короткий период.
Оборудование данной категории должно соответствовать дополнительным требованиям Приложения II, 2.3.
Приложение II
ОСНОВНЫЕ ТРЕБОВАНИЯ
ПО ОБЕСПЕЧЕНИЮ ЗДОРОВЬЯ И БЕЗОПАСНОСТИ, ОТНОСЯЩИЕСЯ
К РАЗРАБОТКЕ И КОНСТРУКЦИИ ОБОРУДОВАНИЯ И ЗАЩИТНЫХ СИСТЕМ,
ПРЕДНАЗНАЧЕННЫХ ДЛЯ ИСПОЛЬЗОВАНИЯ ВО ВЗРЫВООПАСНЫХ
АТМОСФЕРАХ
Предварительные замечания
A. Технологические разработки могут быстро меняться и должны учитываться в полной мере и внедряться как можно быстрее.
B. Для устройств, указанных в статье 1 (2), основные требования должны применяться при необходимости для безопасной и надежной работы оборудования с учетом рисков взрывоопасности.
1. ОБЩИЕ ТРЕБОВАНИЯ К ОБОРУДОВАНИЮ И ЗАЩИТНЫМ СИСТЕМАМ
1.0. Общие требования
1.0.1. Принципы комплексной взрывобезопасности
Оборудование и защитные системы, предназначенные для применения в потенциально взрывоопасных атмосферах, должны разрабатываться с учетом комплексной взрывобезопасности.
В этой связи изготовитель должен принять следующие меры:
- по возможности, по предупреждению образования взрывоопасных атмосфер, которые могут возникать в результате работы самого оборудованием или защитных систем;
- по предупреждению воспламенения взрывоопасных атмосфер с учетом особенностей каждого электрического и неэлектрического источника воспламенения;
- по незамедлительной локализации пламени и последствий взрыва, которые могут представлять прямую или косвенную опасность для людей и/или домашних животных и имущества.
1.0.2. Оборудование и защитные системы должны разрабатываться и производиться после анализа возможных эксплуатационных отказов для того, чтобы, по возможности, предупредить возникновение опасных ситуаций.
Следует учитывать любое возможное неправильное применение оборудования.
1.0.3. Специальная проверка и условия обслуживания и ремонта
Оборудование и защитные системы, подлежащие специальной проверке, обслуживанию и ремонту, должны разрабатываться и производиться с учетом этих условий.
1.0.4. Условия окружающей среды
Оборудование и защитные системы должны разрабатываться и производиться с учетом их возможного функционирования в фактических или предполагаемых условиях окружающей среды.
1.0.5. Маркировка
Все оборудование и защитные системы должны иметь читаемую и нестираемую маркировку. Маркировка должна включать:
- наименование и адрес изготовителя;
- маркировку CE (Приложение X, пункт A);
- указание серии или типа;
- серийный номер, при его наличии;
- год изготовления;
- специальную отметку о возможности защиты от взрыва с последующим обозначением группы изделия и его категории;
- для оборудования группы II, букву "G" (взрывоопасные атмосферы, вызванные газом и испарениями) и/или "D" (взрывоопасные атмосферы, вызванные пылью).
Кроме того, при необходимости, маркировка должна содержать всю информацию, имеющую значение для безопасного применения.
1.0.6. Инструкции
a) Все оборудование и защитные системы должны сопровождаться инструкциями, включающими, как минимум, следующую информацию:
- краткие данные, включенные в маркировку оборудования или защитной системы, за исключением серийного номера (п. 1.0.5), а также любую дополнительную информацию для обеспечения обслуживания и ремонта (например, адреса поставщика и организации, занимающейся обслуживанием, ремонтом и т.п.);
- инструкции по безопасности при:
- вводе в эксплуатацию,
- эксплуатации,
- сборке и демонтаже,
- обслуживании (включая аварийный ремонт),
- установке.
- настройке;
- при необходимости, указание опасных участков перед устройствами для сброса давления;
- при необходимости, инструкции по подготовке персонала;
- подробную информацию, позволяющую принять единственно правильное решение относительно того, может ли элемент оборудования конкретной категории или защитная система безопасно применяться в предусмотренной области и предполагаемых производственных условиях;
- электрические параметры и параметры давления, максимальную температуру поверхности и другие предельные значения;
- при необходимости, информацию о специальных условиях эксплуатации, включая возможное неправильное использование;
- при необходимости, информацию об основных характеристиках устройств, которые могут устанавливаться на оборудовании либо защитной системе.
b) Инструкции должны составляться изготовителем либо его законным представителем, зарегистрированным в Сообществе, на одном из языков Сообщества.
При вводе в эксплуатацию все оборудование и защитные системы должны сопровождаться инструкциями, переведенными на язык или языки страны, в которой оборудование или защитная система будут применяться, а также инструкциями на языке страны-изготовителя.
Перевод должен быть осуществлен изготовителем или его законным представителем, зарегистрированным в Сообществе, или лицом, внедряющим оборудование или защитную систему, на указанных языках.
Альтернативой данному требованию являются инструкции по обслуживанию оборудования для персонала, используемого изготовителем либо его законным представителем, зарегистрированным в Сообществе, подготовленные на одном из универсальных языков Сообщества, знакомых персоналу.
c) Инструкции должны содержать рисунки и диаграммы, необходимые для ввода в эксплуатацию, обслуживания, контроля и проверки, при необходимости - ремонта оборудования или защитной системы, а также полезные инструкции, в частности, по обеспечению безопасности.
d) Документация, описывающая оборудование или защитную систему, не должна содержать рекомендации, противоречащие правилам безопасности.
1.1. Выбор материалов
1.1.1. Материалы, используемые при производстве оборудования и защитных систем, не должны быть взрывоопасными при предусмотренных рабочих нагрузках.
1.1.2. В соответствии с производственными условиями, установленными изготовителем, необходимо исключить возможность реакции между используемыми материалами и составляющими потенциально взрывоопасной атмосферы, которая может увеличить взрывоопасность.
1.1.3. Материалы необходимо подбирать таким образом, чтобы предполагаемое изменение их характеристик и совместимость с другими материалами не привели к снижению уровня защиты. В частности, необходимо учитывать коррозию, износостойкость, электрическую проводимость, механическую прочность и сопротивляемость температурному воздействию материалов.
1.2. Разработка и производство
1.2.1. Оборудование и защитные системы должны разрабатываться и производиться с учетом специальных сведений в сфере защиты от взрыва в целях их безопасной эксплуатации в течение срока службы.
1.2.2. Встроенные или сменные компоненты в оборудовании и защитных системах должны разрабатываться с учетом их безопасного функционирования в соответствии с предусмотренным изготовителем применением системы защиты от взрыва.
1.2.3. Закрытые конструкции и предупреждение утечек
Оборудование, которое может выделять легко воспламеняющиеся газы или пыль, должно, по возможности, быть закрытым.
Если оборудование имеет отверстия или негерметичные соединения, они должны, по возможности, быть сконструированы так, чтобы выделяемые газы или пыль не привели к возникновению взрывоопасных атмосфер вне оборудования.
Вводные и выводные участки должны, по возможности, быть спроектированы так, чтобы выделяемые газы или пыль не способствовали образованию легковоспламеняющихся материалов при рабочих циклах.
1.2.4. Пылевые отложения
Оборудование и защитные системы, предназначенные для применения в зонах наличия пыли, должны разрабатываться так, чтобы избежать воспламенения осевшей на их поверхности пыли.
Общая рекомендация - ограничение отложений пыли. Оборудование и защитные системы должны легко подвергаться очистке.
Температуры рабочих поверхностей оборудования должны быть ниже температуры воспламенения пыли.
Толщина слоя осаждения пыли должна приниматься во внимание для принятия мер по ограничению повышения температуры воспламенения.
1.2.5. Дополнительные меры защиты
Оборудование и защитные системы, которые могут подвергаться внешним рискам, при необходимости, должны снабжаться дополнительными средствами защиты.
Оборудование должно выдерживать внешнее воздействие без повышения взрывоопасности.
1.2.6. Безопасность при распаковке
Если оборудование или защитные системы имеют корпусную или контейнерную упаковку, которые сами по себе служат защитой от взрыва, упаковка должна открываться только с помощью специальных инструментов или с применением соответствующих средств защиты.
1.2.7. Защита от других рисков
Оборудование и защитные системы должны разрабатываться и производиться таким образом, чтобы:
a) избежать физического или иного повреждения в результате прямого и непрямого контакта;
b) исключить возможность возникновения таких температур или излучения, которые могут привести к опасной ситуации;
c) избежать опасности неэлектрического характера, выявленной на основании имеющегося опыта;
d) убедиться, что предполагаемые условия перегрузок не приведут к возникновению опасных ситуаций.
Если для оборудования или защитных систем применимы вышеуказанные риски, которые предусмотрены в других Директивах Сообщества, настоящая Директива не должна применяться.
1.2.8. Перегрузка оборудования
Опасная перегрузка оборудования должна предотвращаться на стадии разработки путем использования в комплексе таких измерительных, контролирующих и управляющих устройств, как выключатели предельных токов, ограничителей температуры, дифференциальных реле давления, измерителей расхода, временных реле, индикаторов превышения скорости и/или аналогичных приборов контроля.
1.2.9. Системы с взрывонепроницаемой оболочкой
Если части, которые могут воспламенить окружающую атмосферу, помещаются в оболочку, необходимо принять меры, чтобы эта оболочка выдерживала давление, возникающее во время внутреннего взрыва взрывчатой смеси и предупреждала распространение последствий взрыва во взрывоопасной атмосфере.
1.3. Потенциальные источники воспламенения
1.3.1. Риски, связанные с различными источниками воспламенения
Не должно возникать потенциальных источников воспламенения, таких, как искры, пламя, электрические дуги, высокая температура поверхности, акустическая энергия, оптическое излучение, электромагнитные волны и др.
1.3.2. Опасность, возникающая от статического электричества
Необходимо принять меры по воспрепятствованию возникновения электростатических зарядов, способных вызвать опасные электрические разряды.
1.3.3. Риски, связанные с прямым электрическим током и током утечки
Эти токи в проводящих частях могут привести к опасной коррозии, перегреву поверхностей или возникновению искр, ведущих к воспламенению. Необходимо принять меры во избежание данных рисков.
1.3.4. Опасности от перегрева
При разработке следует предусмотреть перегрев, вызванный трением между деталями, возникающим в результате контакта между частями в рабочем режиме или появления инородных частиц.
1.3.5. Риски, возникающие при компенсации давления
Оборудование и защитные системы должны предусматривать наличие встроенных измерительных, контролирующих регулирующих устройств так, чтобы компенсация давления не вызывала ударных волн или сжатий, которые могут быть причиной воспламенения.
1.4. Риски внешних воздействий
1.4.1. Оборудование и защитные системы должны разрабатываться и производиться так, чтобы они могли безопасно функционировать даже в изменяющихся условиях окружающей среды и при наличии внешнего воздействия, такого, как повышение напряжения, влажность, вибрация, загрязнения и другого с учетом пределов рисков производственных условий, установленных изготовителем.
1.4.2. Используемые части оборудования должны быть рассчитаны на соответствующие механические и тепловые нагрузки и должны выдерживать воздействие существующих и предполагаемых агрессивных веществ.
1.5. Требования к устройствам безопасности
1.5.1. Устройства безопасности должны функционировать независимо от работы измерительного и/или контрольного оборудования.
Отказ устройства безопасности должен выявляться как можно быстрее с помощью соответствующих технических средств для сведения к минимуму вероятности возникновения опасных ситуаций.
В основе должен лежать принцип отказоустойчивости.
Отключение системы безопасности должно непосредственно приводить в действие соответствующие средства управления без промежуточной команды программного обеспечения.
1.5.2. При отказе устройства безопасности оборудование и/или защитные системы должны быть, по возможности, обеспечены защитой.
1.5.3. Средства управления аварийной остановки защитных устройств должны, по возможности, быть оборудованы средствами блокировки повторного запуска. Новая команда запуска может быть выполнена только после снятия блокировки повторного запуска.
1.5.4. Устройства управления и отображения
Применяемые устройства управления и отображения должны разрабатываться в соответствии с эргономическими принципами для обеспечения максимальной эксплуатационной безопасности в отношении риска взрыва.
1.5.5. Требования к устройствам с измерительными функциями по защите от взрыва
Поскольку такие устройства используются во взрывоопасных атмосферах, они должны разрабатываться и производиться с учетом использования в специфических условиях.
1.5.6. При необходимости должна быть обеспечена возможность проверки точности и надежности считанных данных измерительных приборов.
1.5.7. При разработке измерительных приборов должен учитываться фактор безопасности, гарантирующий существование аварийного порога в значительной отдаленности от предела действия взрыва и/или воспламенения атмосфер, особенно, в производственных условиях.
1.5.8. Риски, связанные с программным обеспечением
При проектировании оборудования с программным управлением для защитных устройств и устройств безопасности должны особо учитываться риски, связанные с ошибками в программе.
1.6. Комплексные требования безопасности к системе
1.6.1. Ручное управление с блокировкой автоматики должно действовать при отключении оборудования и защитных систем, включенных в автоматизированные процессы, которые могут не соответствовать предусмотренным рабочим условиям, если это не влияет на безопасность.
1.6.2. Когда задействуется система аварийного отключения, аккумулированная энергия должна, по возможности, быстро и безопасно рассеиваться или выделяться.
Это не касается выделения электрохимической энергии.
1.6.3. Риски, связанные с нарушением энергоснабжения
Если оборудование и защитные системы могут создать дополнительные риски, связанные с нарушением электроснабжения, их необходимо размещать на безопасном расстоянии от основной установки.
1.6.4. Риски, связанные с соединениями
Оборудование и защитные системы должны оснащаться кабельными и согласованными с кабелем портами.
Если оборудование и защитные системы предполагается использовать в сочетании с другим оборудованием и защитными системами, необходимо обеспечить безопасность сопряжения.
1.6.5. Размещение устройств предупредительной сигнализации как частей оборудования
Если оборудование или защитные системы имеют устройства предупредительной сигнализации для отслеживания взрывоопасных атмосфер, это должно быть отражено в надлежащих инструкциях.
2. ДОПОЛНИТЕЛЬНЫЕ ТРЕБОВАНИЯ К ОБОРУДОВАНИЮ
2.0. Требования к оборудованию группы I категории M 1
2.0.1. Требования, предъявляемые к оборудованию группы I категории M 1
2.0.1.1. Оборудование должно изготавливаться так, чтобы источники воспламенения не активировались при неполадках оборудования.
Оборудование должно оснащаться такими средствами защиты, чтобы:
- при отказе одного из средств защиты, необходимый уровень защиты обеспечивался, по крайней мере, другим автономным средством;
- или необходимый уровень защиты обеспечивался при двух отказах, происшедших независимо друг от друга.
При необходимости такое оборудование должно быть обеспечено дополнительными средствами защиты, которые должны функционировать во взрывоопасных атмосферах.
2.0.1.2. При необходимости конструкция такого оборудования должна обеспечивать его от проникновения пыли.
2.0.1.3. Температуры рабочих поверхностей оборудования должны быть ниже температур возможного воспламенения смесей воздуха и пыли во избежание возгорания взвешенной пыли.
2.0.1.4. Оборудование должно разрабатываться так, чтобы части оборудования, которые могут стать источниками воспламенения, открывались только в нерабочем состоянии или в условиях безопасности от возгорания. Если оборудование нельзя отключить, изготовитель должен снабдить открывающуюся часть оборудования предупреждающим знаком. При необходимости оборудование должно обеспечиваться дополнительными системами блокировки.
2.0.2. Требования, предъявляемые к оборудованию группы I категории M 2
2.0.2.1. Оборудование должно иметь средства защиты для обеспечения того, чтобы источники воспламенения не активировались как при нормальной эксплуатации, так и при ухудшении производственных условий, в частности, в случае небрежного обращения и изменения условий окружающей среды.
Оборудование должно обесточиваться при наличии взрывоопасной атмосферы.
2.0.2.2. Оборудование должно разрабатываться таким образом, чтобы открытие частей оборудования, могущих послужить источником воспламенения, было возможным только в нерабочем (неактивном) состоянии или с использованием соответствующих систем блокировки. Если не имеется возможности привести оборудование в неактивное состояние, изготовитель должен снабдить открывающуюся часть предупреждающим знаком.
2.0.2.3. К категории M 1 применяются требования, касающиеся защиты от взрывоопасности при наличии пыли.
2.1. Требования, предъявляемые к оборудованию
группы II категории 1
2.1.1. Взрывоопасные атмосферы, возникающие в результате образования газов, паров или туманов.
2.1.1.1. Оборудование должно разрабатываться и производиться так, чтобы исключить активацию источников воспламенения даже при редких сбоях в работе оборудования.
Оборудование должно оснащаться такими средствами защиты, чтобы:
- при отказе одного средства защиты необходимый уровень защиты обеспечивался, по крайней мере, другим автономным средством защиты;
- или необходимый уровень защиты обеспечивался при двух отказах, происшедших независимо друг от друга.
2.1.1.2. Если рабочие поверхности подвержены нагреванию, необходимо принять меры, исключающие превышение температуры максимального нагрева поверхностей даже при возникновении неблагоприятных условий.
Следует принимать во внимание повышение температуры внешних конструкций и вследствие происходящих химических реакций.
2.1.1.3. Оборудование должно разрабатываться таким образом, чтобы части оборудования, которые могут служить причиной возгорания, открывались только в неактивном состоянии или при условиях обеспечения полной безопасности. При невозможности отключения оборудования изготовитель должен снабдить открывающиеся части предупреждающим знаком.
При необходимости оборудование снабжается дополнительными системами блокировки.
2.1.2. Взрывоопасные атмосферы, вызванные смесями воздуха и пыли
2.1.2.1. Оборудование должно разрабатываться и производиться так, чтобы смеси воздуха и пыли не воспламенялись даже при отдельных неполадках оборудования.
Оборудование должно иметь такие средства защиты, чтобы:
- при отказе одного средства защиты необходимый уровень защиты обеспечивался, по крайней мере, другим автономным средством защиты;
- или необходимый уровень защиты обеспечивался при двух отказах, происшедших независимо друг от друга.
2.1.2.2. При необходимости оборудование разрабатывается так, чтобы пыль проникала и выводилась из оборудования в специально предназначенных для этого местах.
Этому требованию должны также удовлетворять кабельные порты и соединения.
2.1.2.3. Температуры рабочих поверхностей оборудования должны быть ниже температур воспламенения смесей воздуха и пыли, чтобы избежать воспламенения взвешенной пыли.
2.1.2.4. Для безопасного открытия частей оборудования применяются требования, предусмотренные п. 2.1.1.3.
2.2. Требования, предъявляемые к оборудованию
группы II категории 2
2.2.1. Взрывоопасные атмосферы, вызванные смесями воздуха и пыли
2.2.1.1. Оборудование должно разрабатываться с учетом предотвращения воспламенения даже в случае неполадок и несоответствующего управления оборудованием.
2.2.1.2. Части оборудования должны изготавливаться и производиться так, чтобы температуры рабочих поверхностей не превышались даже при возникновении аварийных, спрогнозированных изготовителем.
2.2.1.3. Оборудование должно разрабатываться и производиться таким образом, чтобы части оборудования, могущие послужить источником воспламенения, открывались только в выключенном состоянии и с использованием соответствующих систем блокировки. Если выключение оборудование невозможно, изготовитель должен снабдить открывающуюся часть оборудования предупреждающим знаком.
2.2.2. Взрывоопасные атмосферы, вызванные смесями воздуха и пыли
2.2.2.1. Оборудование должно разрабатываться и производиться таким образом, чтобы избежать возникновения источников воспламенения при прогнозируемых нештатных ситуациях.
2.2.2.2. К температурам рабочих поверхностей применяются требования п. 2.1.2.3.
2.2.2.3. К способам защиты от пыли применяются требования п. 2.1.2.2.
2.2.2.4. К требованиям обеспечения безопасности к открытию частей оборудования применяются положения п. 2.2.1.3.
2.3. Требования, предъявляемые к оборудованию
группы II категории 3
2.3.1. Взрывоопасные атмосферы, вызванные газами, парами или туманами
2.3.1.1. Оборудование должно разрабатываться и производиться таким образом, чтобы избежать предполагаемых источников воспламенения, которые могут возникнуть при нормальных условиях работы оборудования.
2.3.1.2. Температуры рабочих поверхностей не должны превышать установленные температуры при нормальных рабочих условиях. Превышение температур в исключительных ситуациях допускается, если изготовитель использует дополнительные средства защиты.
2.3.2. Взрывоопасные атмосферы, вызываемые смесями воздуха и пыли
2.3.2.1. Оборудование должно разрабатываться и производиться таким образом, чтобы пыль, с учетом размера частиц, не могла образовывать взрывоопасные смеси с воздухом или создавать опасную концентрацию внутри оборудования.
2.3.2.2. К температурам рабочих поверхностей применяются требования п. 2.1.2.3.
2.3.2.3. Оборудование, включая кабельные порты и соединения, должно быть создано таким образом, в том числе и его части, чтобы пыль не образовывала взрывоопасную смесь с воздухом, а также формы опасных скоплений внутри оборудования.
3. ДОПОЛНИТЕЛЬНЫЕ ТРЕБОВАНИЯ К ЗАЩИТНЫМ СИСТЕМАМ
3.0. Общие требования
3.0.1. Размеры защитных систем должны разрабатываться таким образом, чтобы уменьшить воздействие взрыва до достаточного уровня безопасности.
3.0.2. Защитные системы должны разрабатываться и устанавливаться так, чтобы избежать распространения взрывов по принципу цепной реакции, воспламенения или детонации.
3.0.3. В случае нарушения электроснабжения защитные системы должны сохранять способность функционирования в течение периода времени, необходимого для ликвидации опасной ситуации.
3.0.4. Защитные системы не должны выходить из строя под влиянием внешних помех.
3.1. Проектирование и разработка
3.1.1. Характеристики материалов
При выборе характеристик материалов в качестве показателя максимальных значений давления и температуры должно рассматриваться предполагаемое давление при взрыве, который может произойти в обычных производственных условиях и прогнозируемом тепловом воздействии пламени.
3.1.2. Защитные системы, предназначенные для противодействия или уменьшения последствий взрывов, должны выдерживать ударную волну без потери свойств целостности системы.
3.1.3. Элементы, соединенные с защитными системами, должны быть в состоянии выдержать максимальное давление от взрыва без потери функциональной способности.
3.1.4. При проектировании защитных систем следует учитывать воздействие, вызванное давлением на периферийные системы и подсоединенные коммуникационные системы.
3.1.5. Системы, снижающие давление
При наличии возможности ухудшения воздействия на защитные системы, следует предусмотреть необходимость использования понижающих давление устройств, не создающих опасность для людей, находящихся рядом.
3.1.6. Системы подавления взрыва
Системы подавления взрыва, должны проектироваться и разрабатываться так, чтобы они реагировали на начальную взрывоопасную стадию и эффективно противодействовали взрыву в условиях увеличения скорости повышения давления и максимального давления.
3.1.7. Системы локализации взрыва
Данные системы должны проектироваться и разрабатываться для максимально быстрого отключения специального оборудования при взрывоопасности посредством специальных устройств, воспрепятствовать распространению возгорания и сохранять механическую целостность в производственных условиях.
3.1.8. Защитные системы должны иметь возможность сопряжения со схемой с соответствующим порогом включения аварийной сигнализации, так, чтобы при необходимости обеспечивали прекращение поступления и выхода продукта и отключение тех частей оборудования, дальнейшее функционирование которых не обеспечивает должного уровня безопасности.
Приложение III
МОДУЛЬ: ИСПЫТАНИЕ НА СООТВЕТСТВИЕ ЕС
1. Данный модуль описывает ту часть процедуры, с помощью которой уполномоченный орган определяет и подтверждает, что представленный образец продукции отвечает соответствующим требованиям положений Директивы.
2. Данное испытание на соответствие ЕС производится изготовителем или его законным представителем, зарегистрированным в Сообществе, в уполномоченном органе по выбору.
Заявка на проведение испытания должна включать:
- название и адрес изготовителя либо его законного представителя при подаче заявки последним;
- письменное уведомление, что подобная заявка не подавалась другой уполномоченной организацией;
- техническую документацию, указанную в п. 3.
Заявитель должен предоставить уполномоченному органу типовой образец тестируемой продукции, именуемый в дальнейшем "типовой образец". Уполномоченный орган может запросить дополнительные образцы, если они необходимы для выполнения программы тестирования.
3. Техническая документация должна позволить оценить соответствие изделия требованиям Директивы. Техническая документация должна включать информацию, касающуюся конструктивных особенностей и работы изделия необходимую для проведения тестирования и содержать:
- общее описание типового образца;
- проектные и производственные чертежи и схемы компонентов, узлов, цепей и т.п.;
- описания и пояснения к данным чертежам и схемам, касающимся работы изделия;
- перечень стандартов, указанных в статье 5, примененных полностью или частично, а также решений, выбранных для приведения в соответствие с этими требованиями, если стандарты не применялись;
- результаты выполнения проектных расчетов, проведенных проверок и т.п.;
- протоколы испытаний.
4. Уполномоченный орган должен:
4.1. изучить техническую документацию, подтвердить, что типовой образец изготовлен в соответствии с ней, определить элементы, спроектированные с положениями стандартов, установленных статьей 5, а также компоненты, разработанные и использованные без применения стандартов;
4.2. провести или организовать проведение соответствующих проверок и необходимых испытаний с целью определения соответствия или несоответствия стандартам статьи 5 и положениям Директивы;
4.3. провести или организовать проведение соответствующих проверок и необходимых испытаний с целью определения, были ли стандарты применены фактически, если они выбраны изготовителем;
4.4. согласовать с заявителем место проведения проверок и испытаний.
5. Если типовой образец соответствует положениям Директивы, уполномоченный орган должен выдать заявителю сертификат ЕС об испытании типового образца. Сертификат включает наименование и адрес изготовителя, выводы по результатам тестирования и необходимые идентификационные данные утвержденного типового образца.
Перечень существенных разделов технической документации прилагается к сертификату, а копии остаются у уполномоченного органа.
Если изготовителю или его законному представителю в Сообществе отказано в сертификации типового образца, уполномоченный орган должен предоставить подробное обоснование отказа.
Должна быть предусмотрена процедура обжалования.
6. Заявитель должен сообщить уполномоченному органу, где хранится техническая документация по выданному сертификату ЕС, обо всех изменениях в сертифицированном оборудовании или защитных системах для дальнейшего утверждения этих изменений, если последние могут не соответствовать требованиям, либо установленным условиям функционирования данных изделий. При этом необходимо согласие на использование оборудования, оформленное дополнительным сертификатом проверки на соответствие ЕС.
7. Каждый уполномоченный орган должен обеспечить другие уполномоченные органы своевременной информацией о сертификатах соответствия ЕС, в том числе выданных дополнительно и отозванных.
8. Другие уполномоченные органы могут получать копии сертификатов ЕС об испытаниях типового образца и/или дополнения к ним. Приложения к сертификатам также должны предоставляться в распоряжение других уполномоченных органов.
9. Изготовитель либо его законный представитель, зарегистрированный в Сообществе, должен хранить вместе с технической документацией копии сертификатов ЕС об испытаниях типового образца и дополнений к ним не менее 10 лет после изготовления последней единицы оборудования или защитной системы.
Если изготовитель или его законный представитель не зарегистрированы в Сообществе, ответственность за хранение технической документации возлагается на лицо, поставившее продукцию на рынок Сообщества.
Приложение IV
МОДУЛЬ: ПОДТВЕРЖДЕНИЕ КАЧЕСТВА ПРОИЗВОДСТВА
1. В настоящем модуле описывается процедура, с помощью которой изготовитель, выполнивший требования пункта 2, утверждает и заявляет, что представляемые изделия соответствуют типу, описанному в сертификате ЕС об испытаниях типового образца, и применимым к ним требованиям Директивы. Изготовитель или его законный представитель, зарегистрированный в Сообществе, должны нанести на каждую единицу оборудования маркировку CE и подготовить декларацию соответствия в установленной письменной форме. Маркировка CE сопровождается идентификационным номером уполномоченного органа, ответственного за контроль соблюдения CE в соответствии с разделом 4.
2. Изготовитель должен применять утвержденную систему качества производства, проверок оборудования и испытаний, указанную в разделе 3, и контроля, указанную в разделе 4.
3. Система оценки качества
3.1. Изготовитель должен подать заявку на оценку системы качества для данного оборудования уполномоченному органу по выбору.
Заявка должна включать:
- всю необходимую информацию о спроектированном изделии;
- документацию, касающуюся системы качества;
- техническую документацию на принятый тип изделия и копию сертификата тестирования на предмет соответствия ЕС.
3.2. Система качества должна обеспечивать соответствие оборудования с типом, указанным в сертификате ЕС и соответствующим положениям Директивы.
Все элементы, требования и положения, принятые изготовителем, должны сопровождаться документами в систематизированном порядке и в форме письменных методик, процедур и инструкций. Документация по системе качества должна, по возможности, позволить последовательно интерпретировать программы качества, планы, руководства и другие документы.
Она, в частности, должна содержать соответствующее описание:
- целей системы качества и организационной структуры, компетенции и полномочий руководства по обеспечению качества оборудования;
- производства, контроля качества, процесса обеспечения качества, включая процедуры и алгоритм действий;
- проверок и испытаний, которые будут проводиться до, в процессе и после производства, а также частоты их проведения;
- документов по качеству, например, отчетов об инспекционном контроле и данных о результатах испытаний, калибровке, докладов о квалификации задействованного персонала и т.п.;
- средств мониторинга процесса достижения необходимого качества оборудования и эффективного действия системы качества.
3.3. Уполномоченный орган должен оценить систему качества с целью определения ее соответствия требованиям, указанным в разделе 3.2. Он должен исходить из соответствия этим требованиям тех систем качества, где применяется соответствующий унифицированный стандарт. Проверяющая группа должна включать в свой состав, по крайней мере, одного сотрудника с опытом оценки проверяемой технологии. Процедура оценки должна предусматривать инспектирование производственных помещений изготовителя. О принятом решении уведомляется изготовитель. Уведомление должно содержать данные о результатах проверки и обоснование принятого решения.
3.4. Изготовитель должен предоставить гарантии исполнения обязательств, возникших у него в связи с положительным решением, и обеспечить адекватное и эффективное использование системы.
Изготовитель либо его законный представитель должны сообщать в уполномоченный орган, одобривший систему качества, о любых предполагаемых изменениях системы качества.
Уполномоченный орган должен дать оценку таким изменениям и принять решение, соответствует ли измененная система качества требованиям, установленным в разделе 3.2, или требуется повторная оценка.
Он должен уведомить изготовителя о принятом решении. Уведомление должно содержать данные о результатах проверки и обоснование принятого решения.
4. Наблюдение под ответственность уполномоченного органа
4.1. Цель наблюдения - убедиться, что изготовитель надлежащим образом выполняет свои обязательства, вытекающие из решения, одобрившего систему качества.
4.2. Изготовитель должен обеспечить уполномоченному органу в инспекционных целях возможность доступа в помещения, где осуществляется производство, контроль, испытания и хранение, и предоставить всю необходимую информацию, в частности:
- документацию на систему качества;
- сообщения, касающиеся качества, такие как инспекционные доклады, данные тестирования и калибровки, доклады о квалификации задействованного персонала и т.п.
4.3. Уполномоченный орган должен периодически проводить проверки для того, чтобы удостовериться, что изготовитель сохраняет неизменной и использует систему качества. Сообщения о результатах проверки необходимо представлять изготовителю.
4.4. Кроме того, уполномоченный орган может провести неожиданную инспекцию изготовителя. Во время таких внезапных инспекций уполномоченный орган может, при необходимости, провести или организовать проведение тестирования надлежащего использования системы качества. Уполномоченный орган должен подготовить для изготовителя сообщение об инспектировании, а при проведении тестирования - доклад о его результатах.
5. Изготовитель должен хранить и обеспечивать свободный доступ национальным уполномоченным органам в течение 10 лет с момента выпуска последней единицы оборудования к:
- документации, определенной во втором абзаце раздела 3.1;
- сведениям об изменениях, определенных параграфом 2 раздела 3.4;
- решениям и отчетам уполномоченных органов, на которые сделаны ссылки в последнем параграфе раздела 3.4, разделах 4.3 и 4.4.
6. Каждый уполномоченный орган должен предоставить другим уполномоченным органам информацию об утвержденных и аннулированных решениях по системам качества.
Приложение V
МОДУЛЬ: ПРОВЕРКА ИЗДЕЛИЯ
1. Данный модуль описывает процедуру, с помощью которой изготовитель или его законный представитель, зарегистрированный в Сообществе, проверяют и удостоверяют, что оборудование, указанное в пункте 3, соответствует типовому образцу, описанному в сертификате CE, и требованиям Директивы.
2. Изготовитель должен принять все необходимые меры, чтобы процесс производства гарантировал соответствие оборудования типовому образцу, описанному в сертификате ЕС, и требованиям Директивы. Изготовитель либо его законный представитель, зарегистрированный в Сообществе, должны нанести на каждую часть оборудования маркировку CE и подготовить декларацию соответствия.
3. Уполномоченный орган должен провести соответствующие проверки и испытания для определения соответствия оборудования, защитной системы или устройств, определенных статьей 1 (2), требованиям Директивы посредством проверки и испытания каждого изделия, как определено разделом 4.
Изготовитель либо его законный представитель должны хранить копию декларации соответствия не менее 10 лет после изготовления последней единицы оборудования.
4. Проверка путем изучения и испытания каждой единицы оборудования
4.1. Все единицы оборудования должны проверяться индивидуально и проходить испытания в соответствии с подходящим стандартом, определенным статьей 5, или эквивалентные испытания для проверки их соответствия образцу, описанному в сертификате ЕС, и требованиям Директивы.
4.2. Уполномоченный орган должен нанести свой идентификационный номер (если он не был нанесен ранее) на каждую единицу оборудования и составить письменно сертификат соответствия по результатам проведенных испытаний.
4.3. Изготовитель или его законный представитель по запросу должны обеспечить представление сертификатов соответствия, выданных уполномоченным органом.
Приложение VI
МОДУЛЬ: СООТВЕТСТВИЕ ТИПОВОМУ ОБРАЗЦУ
1. В настоящем модуле описывается та часть процедуры, с помощью которой изготовитель или его законный представитель, зарегистрированный в Сообществе, обеспечивают и заявляют о соответствии этого оборудования образцу, описанному в сертификате ЕС, и требованиям Директивы. Изготовитель или его законный представитель, зарегистрированный в Сообществе, должны нанести маркировку CE на каждую единицу оборудования и подготовить письменно декларацию о соответствии.
2. Изготовитель должен принять необходимые меры для того, чтобы процесс производства обеспечивал соответствие изготовленного оборудования образцу, описанному в сертификате ЕС, и требованиям Директивы.
3. Изготовитель или его законный представитель должны хранить копию декларации соответствия не менее 10 лет после изготовления последней единицы оборудования. Если ни изготовитель, ни его уполномоченный представитель не зарегистрированы в Сообществе, ответственность за хранение технической документации возлагается на лицо, которое поставляет оборудование или защитную систему на рынок Сообщества.
Для каждой единицы изготовленного оборудования должны проводиться испытания на предмет защиты от взрывоопасности изготовителем или от его имени. За испытания должен нести ответственность уполномоченный орган, выбранный изготовителем.
Уполномоченный орган должен проконтролировать нанесение на оборудование его идентификационного номера, которое производится изготовителем в процессе производства.
Приложение VII
МОДУЛЬ: ГАРАНТИЯ КАЧЕСТВА ПРОДУКЦИИ
1. В настоящем модуле описывается процедура, с помощью которой изготовитель, выполнивший требования раздела 2, обеспечивает и заявляет о соответствии оборудования типовому образцу, описанному в сертификате ЕС. Изготовитель или его законный представитель, зарегистрированный в Сообществе, должны нанести на каждое изделие маркировку CE и подготовить письменно декларацию соответствия. Маркировка CE сопровождается идентификационным номером уполномоченного органа, ответственного за контроль (раздел 4).
2. Изготовитель должен применять утвержденную систему качества для итогового контроля и испытания оборудования, как определено ниже в разделе 3, и пройти производственную проверку, предписанную ниже в разделе 4.
3. Система качества
3.1. Изготовитель должен подать заявку на оценку своей системы качества оборудования в уполномоченный орган по своему выбору.
Заявка должна включать:
- всю необходимую информацию по рассматриваемой категории изделий;
- документацию на систему качества;
- техническую документацию на одобренный типовой образец и копию сертификата ЕС об испытании типового образца.
3.2. В рамках системы качества каждая единица оборудования должна проверяться и тестироваться в соответствии с подходящим стандартом, определенным в статье 5, или проходить эквивалентные испытания для проверки их соответствия требованиям Директивы. Все элементы, требования и положения, принятые изготовителем в его системе качества, должны обеспечиваться документацией, представленной в логическом и систематизированном порядке в виде письменных методик, процедур и инструкций. Документация по системе качества должна, по возможности, единообразно интерпретировать стратегии и процедуры обеспечения качества, например, программы, планы и документы по качеству.
Она включает, в частности, адекватное описание:
- целей системы качества и организационной структуры компетенции и полномочий руководства по обеспечению качества оборудования;
- проверок и испытаний, которые намечено провести после изготовления;
- средств контроля эффективного применения системы качества;
- документов по качеству, например, отчетов об инспекционном контроле данных о результатах испытаний, калибровки, отчетов по квалификации задействованного персонала и т.п.
3.3. Уполномоченный орган должен оценить систему качества, чтобы определить, удовлетворяет ли она требованиям, определенным в разделе 3.2. Он должен исходить из предположения соответствия требованиям в отношении систем качества, которые определены применимым унифицированным стандартом.
Проверяющая группа должна включать, по меньшей мере, одного сотрудника, который имеет опыт оценки данной технологии. Процедура оценки должна включать инспекционное посещение производственных помещений изготовителя.
О решении необходимо уведомить изготовителя. Уведомление должно содержать заключение по проверке и обоснованное решение по оценке.
3.4. Изготовитель должен гарантировать выполнение обязательств, вытекающих из утвержденной системы качества, т.е. обеспечивать ее надлежащее и эффективное функционирование.
Изготовитель или его законный представитель должны информировать уполномоченный орган, утвердивший систему качества, о любых планируемых изменениях данной системы.
Уполномоченный орган должен оценить предложенные изменения и принять решение, соответствует ли измененная система качества требованиям, установленным в разделе 3.2, или требуется повторная оценка.
Он должен уведомить изготовителя о принятом решении. Уведомление должно содержать результаты проверки и обоснованную оценку.
4. Контроль под ответственность уполномоченного органа
4.1. Цель контроля - убедиться, что изготовитель надлежащим образом выполняет обязательства, вытекающие из утвержденной системы качества.
4.2. Изготовитель должен обеспечить уполномоченному органу возможность доступа в помещения производства, контроля, испытания и хранения в инспекционных целях, а также предоставить ему всю необходимую информацию, в частности:
- документацию по системе качества;
- техническую документацию;
- документацию по качеству, например, отчеты об инспекционном контроле, данные по результатам испытаний, калибровке, отчеты по квалификации задействованного персонала и т.п.
4.3. Уполномоченный орган должен периодически проводить контрольные проверки, чтобы убедиться в том, что изготовитель применяет утвержденную систему качества, и представлять изготовителю отчеты по проведенным проверкам.
4.4. Кроме того, уполномоченный орган может проводить внезапные проверки изготовителя. Во время этих проверок уполномоченный орган может проводить или организовывать проведение испытаний для проверки надлежащего применения системы качества. Он должен представить изготовителю отчет по результатам такой проверки, а если проводились испытания, то отчет об их результатах.
5. В течение 10 лет после производства последней единицы оборудования изготовитель должен обеспечивать национальным уполномоченным органам доступ к:
- документации, определенной третьим абзацем раздела 3.1;
- информации об изменениях, определенных вторым параграфом раздела 3.4;
- решениям и отчетам уполномоченного органа, указанным в последнем параграфе раздела 3.4, разделах 4.3 и 4.4.
6. Каждый уполномоченный орган должен информировать другие уполномоченные органы о решениях об утверждении систем качества и об аннулировании таких решений.
Приложение VIII
МОДУЛЬ: ВНУТРЕННИЙ ПРОИЗВОДСТВЕННЫЙ КОНТРОЛЬ
1. В настоящем модуле описывается процедура, с помощью которой изготовитель или его уполномоченный представитель, зарегистрированный в Сообществе, при выполнении обязательств, установленных в разделе 2, ответственно заявляют, что данное оборудование удовлетворяет соответствующим требованиям Директивы. Изготовитель или его законный представитель, зарегистрированный в Сообществе, должны нанести маркировку CE на каждую часть оборудования и представить письменно декларацию соответствия.
2. Изготовитель должен подготовить техническую документацию, описанную в разделе 3, и сам изготовитель или его законный представитель, зарегистрированный в Сообществе, должны хранить ее и представить национальным уполномоченным органам в течение 10 лет после выпуска последней единицы оборудования.
Если ни изготовитель, ни его законный представитель не зарегистрированы в Сообществе, обязанности хранения и представления необходимой технической документации возлагаются на лицо, поставившее оборудование на рынок Сообщества.
3. Техническая документация должна позволять провести оценку соответствия оборудования требованиям Директивы. Она должна в полном объеме, необходимом для оценки, включать в себя сведения о проектировании, производстве и работе оборудования, т.е.:
- общее описание оборудования;
- концептуальные проектные и производственные чертежи и схемы компонентов, узлов, цепей и т.п.;
- описания и пояснения к этим чертежам и схемам и работе оборудования;
- перечень стандартов, примененным полностью или частично, описание решений, принятых для обеспечения требований безопасности Директивы, если стандарты не применялись;
- результаты проведенных проектных расчетов, проверок и т.п.;
- протоколы испытаний.
4. Изготовитель или его законный представитель должны хранить копию декларации соответствия вместе с технической документацией.
5. Изготовитель должен принять все необходимые меры для того, чтобы процесс производства обеспечивал соответствие изготовленного оборудования требованиям технической документации, указанной в разделе 2, и применяемым к нему положениям Директивы.
Приложение IX
МОДУЛЬ: ЕДИНИЧНАЯ ПРОВЕРКА
1. В настоящем модуле описывается процедура, с помощью которой изготовитель ответственно заявляет о том, что оборудование или защитная система, на которые был выдан сертификат, описанный в разделе 2, отвечают соответствующим им требованиям Директивы. Изготовитель или его законный представитель, зарегистрированный в Сообществе, наносят маркировку CE на оборудование или защитную систему и составляют декларацию соответствия.
2. Уполномоченный орган должен проверить оборудование или защитную систему и произвести необходимые испытания, предусмотренные статьей 5, или с помощью эквивалентного тестирования, чтобы убедиться в их соответствии требованиям Директивы.
Уполномоченный орган должен нанести или инициировать нанесение своего идентификационного номера на утвержденные оборудование или защитную систему и представить сертификат соответствия по результатам проведенных испытаний.
3. Техническая документация предназначена для оценки соответствия требованиям Директивы, а также процессов проектирования, производства и работы оборудования или защитной системы. Документация должна содержать:
- общее описание изделия;
- концептуальные проектные и производственные чертежи и схемы компонентов, сборочных узлов, цепей и т.п.;
- описание и пояснения к этим чертежам и схемам, работе оборудования и системе защиты;
- перечень стандартов, определенных статьей 5, и примененных полностью или частично, а также описание решений, принятых для обеспечения соответствия основным требованиям Директивы в том случае, если стандарты, предусмотренные статьей 5, не применялись;
- результаты проведенных проектных расчетов, проверок и т.п.;
- протоколы испытаний.
Приложение X
A. Маркировка CE
Маркировка CE о соответствии должна состоять из заглавных букв "CE" и отвечать следующим требованиям:
Если размеры маркировки уменьшаются или увеличиваются, должны соблюдаться пропорции вышеуказанного чертежа.
Различные составляющие маркировки CE должны иметь аналогичные вертикальные размеры не менее 5 мм.
Такие размеры могут не соблюдаться для оборудования, защитных систем и устройств малого размера, указанных в статье 1 (2).
B. Содержание декларации соответствия ЕС
Декларация соответствия ЕС должна содержать:
- название или идентификационный знак и адрес изготовителя или его законного представителя, зарегистрированного в Сообществе;
- описание оборудования, защитной системы или устройства, указанных в статье 1 (2);
- описание всех предполагаемых функций оборудования, защитной системы или устройства, определенных в статье 1 (2);
- по возможности, название, идентификационный номер и адрес уполномоченного органа и номер сертификата соответствия ЕС;
- по возможности, ссылку на унифицированные стандарты;
- по возможности, сведения об использованных стандартах и технических спецификациях;
- по возможности, ссылки на иные Директивы Сообщества при их использовании;
- идентификацию подписи лица, уполномоченного представлять изготовителя или его законного представителя, зарегистрированного в Сообществе.
Приложение XI
МИНИМАЛЬНЫЕ КРИТЕРИИ, КОТОРЫМ ДОЛЖНЫ СООТВЕТСТВОВАТЬ
УПОЛНОМОЧЕННЫЕ ОРГАНЫ ГОСУДАРСТВ-ЧЛЕНОВ ЕС
1. Орган, его руководитель и персонал, ответственные за проведение проверочных испытаний, не могут быть проектировщиками, изготовителями, поставщиками, ответственными за установку оборудования, защитных систем или устройств, указанных в статье 1 (2), представителями любой из сторон, которые они проверяют. Они не могут участвовать напрямую или в качестве законных представителей в разработке, конструировании, проектировании, производстве, сбыте или обслуживании оборудования, защитных систем или устройств, указанных в статье 1 (2). Это не исключает возможности обмена технической информацией между изготовителем и уполномоченным органом.
2. Уполномоченный орган и его контролирующий персонал должны проводить проверочные испытания с высокой степенью профессиональной честности и технической компетентности. Они должны быть независимы от любого воздействия и стимулов, в частности, финансовых, которые могут повлиять на их мнение или результаты инспектирования, особенно со стороны лиц, заинтересованных в результатах проверки.
3. Такой орган должен располагать необходимым персоналом и средствами, которые дают ему возможность выполнять надлежащим образом технические и административные задачи, связанные с проверкой. Он также должен иметь доступ к оборудованию, подлежащему проверке.
4. Персонал, отвечающий за проверку, должен иметь:
- соответствующую профессиональную подготовку;
- хорошее знание требований тестирования при соответственном наличии опыта проведения подобного тестирования;
- способность подготовить сертификаты, комментарии и доклады, необходимые для проведения соответствующей процедуры тестирования.
5. Должна быть гарантирована беспристрастность инспекторских проверок. Оплата проверок не должна зависеть от количества проведенных испытаний и их результатов.
6. Орган должен гарантировать достоверность, если достоверность подтверждается государством-членом ЕС в соответствии с законодательством, или само государство-член ЕС несет ответственность за результаты тестирования.
7. Персонал органа обязан соблюдать профессиональную тайну по поводу сведений, полученных в процессе выполнения возложенных на него задач (за исключением очного интервью с представителями властей страны, в которой происходят процедуры) в соответствии с Директивой или национальными нормативными актами, регулирующими соответствующую ситуацию.

Acting in accordance with the procedure referred to in Article 189b of the Treaty establishing the European Community,
Whereas it is the duty of Member States to protect, on their territory, the safety and health of persons and, where appropriate, domestic animals and property and, in particular, that of workers, especially against the hazards resulting from the use of equipment and systems providing protection against potentially explosive atmospheres;
Whereas mandatory provisions within the Member States determine the level of safety to be achieved by protective equipment and systems intended for use in potentially explosive atmospheres; whereas these are generally electrical and non-electrical specifications having an effect on the design and structure of equipment which can be used in potentially explosive atmospheres;
Whereas the requirements to be met by such equipment differ from one Member State to another in respect of their extent and differing inspection procedures; whereas these differences are, therefore, likely to raise barriers to trade within the Community;
Whereas harmonization of national legislation is the only way in which to remove these barriers to free trade; whereas this objective cannot be satisfactorily achieved by the individual Member States; whereas this Directive merely lays down the requirements vital to freedom of movement for the equipment to which it applies;
Whereas the regulations intended to remove technical barriers to trade are required to follow the new approach provided for in the Council resolution of 7 May 1985 <*>, which requires a definition of the essential requirements regarding safety and other requirements of society without reducing existing, justified levels of protection within the Member States; whereas that resolution provides that a very large number of products be covered by a single Directive in order to avoid frequent amendments and the proliferation of Directives;

Whereas the existing Directives on the approximation of the laws of the Member States to electrical equipment for use in potentially explosive atmospheres have made positive steps towards protection against explosions via measures linked with the structure of the equipment at issue and which have helped to remove barriers to trade in this area; whereas, in parallel, a revision and expansion of the existing Directives is necessary since, more particularly, in an overall context, action must be taken to guard against the potential hazards arising from such equipment. This implies in particular that measures intended to guarantee effective protection of users and third parties must already be contemplated at the design and manufacturing states;
Whereas the form taken by the hazard, the protective measures and the test methods are often very similar, if not identical, for both mining and surface equipment; whereas it is, therefore, absolutely necessary to cover by a single Directive protective equipment and systems falling within both groups;
Whereas the two groups of equipment referred to above are used in a large number of commercial and industrial sectors and possess considerable economic significance;
Whereas compliance with the basic safety and health requirements is essential in order to ensure the safety of protective equipment and systems; whereas those requirements have been subdivided into general and additional requirements which must be met by protective equipment and systems; whereas, in particular, the additional requirements are intended to take account of existing or potential hazards; whereas protective equipment and systems will, therefore, embody at least one of those requirements where this is necessary for their proper functioning or is to apply to their intended use; whereas the notion of intended use is of prime importance for the explosion-proofing of protective equipment and systems; whereas it is essential that manufacturers supply full information; whereas specific, clear marking of said equipment, stating its use in a potentially explosive atmosphere, is also necessary;
Whereas the intention is to prepare a Directive on operations in potentially explosive atmospheres which is based on Article 118a; whereas that additional Directive will, in particular, aim at explosion hazards which derive from a given use and/or types and methods of installation;
Whereas compliance with essential health and safety requirements is imperative if the safety of equipment is to be ensured; whereas judgment will have to be exercised in the implementation of those requirements in order to take account of both the technology obtaining at the time of manufacture and overriding technical and economic requirements;
Whereas, therefore, this Directive sets out essential requirements only; whereas, in order to facilitate the task of proving compliance with the essential requirements, harmonized European standards are necessary, more especially with regard to the non-electrical aspects of protection against explosions - standards relating to the design, manufacture and testing of equipment, compliance with which enables a product to be presumed to meet such essential requirements; whereas harmonized European standards are drawn up by private bodies and must retain their non-mandatory status; whereas, for this purpose, the European Committee for Standardization (CEN) and the European Committee for Electrotechnical Standardization (Cenelec) are recognized as the bodies competent to adopt harmonized standards which follow the general guidelines for cooperation between the Commission and those two bodies, signed on 13 November 1984; whereas, for the purposes of this Directive, a harmonized standard is a technical specification (European Standard or harmonization document) adopted by one or other of those bodies, or by both, at the prompting of the Commission pursuant to Council Directive 83/189/EEC of the 28 March 1983 providing for a procedure governing the provision of information on technical standards and regulations <*> and pursuant to the general guidelines referred to above;

Whereas the legislative framework should be improved in order to ensure that employers and workers make an effective and appropriate contribution towards the standardization process; whereas this should be completed by the time this Directive is implemented;
Whereas, in view of the nature of the risks involved in the use of equipment in potentially explosive atmospheres it is necessary to establish procedures applying to the assessment of compliance with the basic requirements of the Directives; whereas these procedures must be devised in the light of the level of risk which may be inherent in equipment and/or against which systems must protect the immediate environment; whereas, therefore, each category of equipment conformity must be supplemented by an adequate procedure or a choice between several equivalent procedures; whereas the procedures adopted comply fully with Council Decision 93/465/EEC of 22 July 1993 concerning the modules for the various phases of the conformity assessment procedures which are intended to be used in the technical harmonization Directives <*>;

Whereas the Council has provided for the affixing of the CE marking by either the manufacturer or his authorized representative within the Community; whereas that marking means that the product complies with all the basic requirements and assessment procedures provided for by the Community law applying to that product;
Whereas it is appropriate that the Member States, as provided for by Article 100a of the Treaty, may take temporary measures to limit or prohibit the placing on the market and the use of equipment and protective systems in cases where they present a particular risk to the safety of persons and, where appropriate, domestic animals or property, provided that the measures are subject to a Community control procedure;
Whereas the recipients of any decision taken as part of this Directive must be aware of the reasons behind that decision and the means of appeal open to them;
Whereas, on 18 December 1985, the Council adopted a framework Directive on electrical equipment for use in potentially explosive atmospheres (76/117/EEC) <*> and, on 15 February 1982, a Directive concerning electrical equipment for use in potentially explosive atmospheres in mines susceptible to fire damp (82/130/EEC) <**>; whereas, from the outset of harmonization work, the conversion into total harmonization of the optional and partial harmonization on which these Directives are based had been contemplated; whereas this Directive fully covers the scope of the abovementioned Directives and whereas, therefore, these Directives must be repealed;

Whereas the internal market incorporates an area without internal frontiers within which the free movement of goods, persons, services and capital is assured;
Whereas it is necessary to provide for a transitional arrangement enabling equipment manufactured in compliance with the national regulations in force at the date of adoption of this Directive to be marketed and placed in service,
Have adopted this Directive:
Chapter I. SCOPE, PLACING ON THE MARKET
AND FREEDOM OF MOVEMENT
Article 1
1. This Directive applies to equipment and protective systems intended for use in potentially explosive atmospheres.
2. Safety devices, controlling devices and regulating devices intended for use outside potentially explosive atmospheres but required for or contributing to the safe functioning of equipment and protective systems with respect to the risks of explosion are also covered by the scope of this Directive.
3. For the purposes of this Directive, the following definitions shall apply:
Equipment and protective systems intended for use in potentially explosive atmospheres
(a) "Equipment" means machines, apparatus, fixed or mobile devices, control components and instrumentation thereof and detection or prevention systems which, separately or jointly, are intended for the generation, transfer, storage, measurement, control and conversion of energy and/or the processing of material and which are capable of causing an explosion through their own potential sources of ignition.
(b) "Protective systems" means devices other than components of the equipment defined above which are intended to halt incipient explosions immediately and/or to limit the effective range of an explosion and which are separately placed on the market for use as autonomous systems.
(c) "Components" means any item essential to the safe functioning of equipment and protective systems but with no autonomous function.
Explosive atmospheres
Mixture with air, under atmospheric conditions, of flammable substances in the form of gases, vapours, mists or dusts in which, after ignition has occurred, combustion spreads to the entire unburned mixture.
Potentially explosive atmosphere
An atmosphere which could become explosive due to local and operational conditions.
Equipment groups and categories
Equipment group I applies to equipment intended for use in underground parts of mines, and in those parts of surface installations of such mines, liable to be endangered by firedamp and/or combustible dust.
Equipment group II applies to equipment intended for use in other places liable to be endangered by explosive atmospheres.
The categories of equipment defining the required levels of protection are described in Annex I.
Equipment and protective systems may be designed for a particular explosive atmosphere. In this case, they must be marked accordingly.
Intended use
The use of equipment, protective systems, and devices referred to in Article 1 (2) in accordance with the equipment group and category and with all the information supplied by the manufacturer which is required for the safe functioning of equipment, protective systems and devices.
4. The following are excluded from the scope of this Directive:
- medical devices intended for use in a medical environment,
- equipment and protective systems where the explosion hazard results exclusively from the presence of explosive substances or unstable chemical substances,
- equipment intended for use in domestic and non-commercial environments where potentially explosive atmospheres may only rarely be created, solely as a result of the accidental leakage of fuel gas,
- personal protective equipment covered by Directive 89/686/EEC <*>,

- seagoing vessels and mobile offshore units together with equipment on board such vessels or units,
- means of transport, i.e. vehicles and their trailers intended solely for transporting passengers by air or by road, rail or water networks, as well as means of transport in so far as such means are designed for transporting goods by air, by public road or rail networks or by water. Vehicles intended for use in a potentially explosive atmosphere shall not be excluded,
- the equipment covered by Article 223 (1) (b) of the Treaty.
Article 2
1. Member States shall take all appropriate measures to ensure that the equipment, protective systems and devices referred to in Article 1 (2) to which this Directive applies may be placed on the market and put into service only if, when properly installed and maintained and used for their intended purpose, they do not endanger the health and safety of persons and, where appropriate, domestic animals or property.
2. The provisions of this Directive shall not affect Member States' entitlement to lay down, in due observance of the provisions of the Treaty, such requirements as they may deem necessary to ensure that persons and, in particular, workers are protected when using the equipment, protective systems, and devices referred to in Article 1 (2) in question provided that this does not mean that such equipment, protective systems, or devices are modified in a way not specified in the Directive.
3. At trade fairs, exhibitions, demonstrations, etc., Member States shall not prevent the showing of equipment, protective systems, or the devices referred to in Article 1 (2) which do not conform to the provisions of this Directive, provided that a visible sign clearly indicates that such equipment, protective systems, and devices referred to in Article 1 (2) do not conform and that they are not for sale until they have been brought into conformity by the manufacturer or his authorized representative established in the Community. During demonstrations, adequate safety measures shall be taken to ensure the protection of persons.
Article 3
Equipment, protective systems, and the devices referred to in Article 1 (2) to which this Directive applies must meet the essential health and safety requirements set out in Annex II which apply to them, account being taken of their intended use.
Article 4
1. Member States shall not prohibit, restrict or impede the placing on the market and putting into service in their territory of equipment, protective systems, or devices referred to in Article 1 (2) which comply with this Directive.
2. Member States shall not prohibit, restrict or impede the placing on the market of components which, accompanied by a written attestation of conformity as referred to in Article 8(3), are intended to be incorporated into equipment or protective systems within the meaning of this Directive.
Article 5
1. Member States shall regard as conforming to all the provisions of this Directive, including the relevant conformity assessment procedures laid down in chapter II:
- equipment, protective systems, and devices referred to in Article 1 (2) accompanied by the EC declaration of conformity referred to in Annex X and bearing the CE marking provided for in Article 10,
- the components referred to in Article 4 (2), accompanied by the certificate of conformity referred to in Article 8 (3).
In the absence of harmonized standards, Member States shall take any steps which they deem necessary to bring to the attention of the parties concerned the existing national technical standards and specifications regarded as important or relevant to the proper implementation of the essential health and safety requirements in Annex II.
2. Where a national standard transposing a harmonized standard, the reference for which has been published in the Official Journal of the European Communities, covers one or more of the essential health and safety requirements, the equipment, protective system, device referred to in Article 1 (2), or the component referred to in Article 4 (2), constructed in accordance with that standard shall be presumed to comply with the relevant essential health and safety requirements.
Member States shall publish the references of national standards transposing harmonized standards.
3. Member States shall ensure that appropriate measures are taken to enable the social partners to influence the process of preparing and monitoring the harmonized standards at national level.
Article 6
1. Where a Member State or the Commission considers that the harmonized standards referred to in Article 5 (2) do not entirely satisfy the relevant essential health and safety requirements referred to in Article 3, the Commission or the Member State concerned shall bring the matter before the Committee set up under Directive 83/189/EEC, hereinafter referred to as "the Committee", giving reasons therefor. The Committee shall deliver an opinion without delay.
Upon receipt of the Committee's opinion, the Commission shall inform the Member States whether or not it is necessary to withdraw those standards from the published information referred to in Article 5 (2).
2. The Commission may adopt any appropriate measure with a view to ensuring the practical application in a uniform manner of this Directive in accordance with the procedure laid down in paragraph 3.
3. The Commission shall be assisted by a standing committee (hereinafter referred to as "the Committee").
Where reference is made to this paragraph, Articles 3 and 7 of Decision 1999/468/EC <*> shall apply, having regard to the provisions of Article 8 thereof.

The Committee shall adopt its rules of procedure.
4. The Standing Committee may furthermore examine any question relating to the application of this Directive and raised by its chairman either on the latter's initiative, or at the request of a Member State.
Article 7
1. When a Member State ascertains that equipment, protective systems or devices referred to in Article 1 (2) bearing the CE conformity marking and used in accordance with their intended use are liable to endanger the safety of persons and, where appropriate, domestic animals or property, it shall take all appropriate measures to withdraw such equipment or protective systems from the market, to prohibit the placing on the market, putting into service or use thereof, or to restrict free movement thereof.
The Member State shall immediately inform the Commission of any such measure, indicating the reasons for its decision and, in particular, whether non-conformity is due to:
(a) failure to satisfy the essential requirements referred to in Article 3;
(b) incorrect application of the standards referred to in Article 5 (2);
(c) shortcomings in the standards referred to in Article 5 (2).
2. The Commission shall enter into consultation with the parties concerned without delay. Where the Commission considers, after this consultation, that the measure is justified, it shall immediately so inform the Member State which took the initiative and the other Member States. Where the Commission considers, after this consultation, that the action is unjustified, it shall immediately so inform the Member State which took the initiative and the manufacturer or his authorized representative established within the Community. Where the decision referred to in paragraph 1 is based on a shortcoming in the standards and where the Member State at the origin of the decision maintains its position, the Commission shall immediately inform the Committee in order to initiate the procedures referred to in Article 6 (1).
3. Where equipment, a protective system or a device referred to in Article 1(2) which does not comply bears the CE conformity marking, the competent Member State shall take appropriate action against the person(s) having affixed the marking and shall so inform the Commission and the other Member States.
4. The Commission shall ensure that the Member States are kept informed of the progress and outcome of this procedure.
Chapter II. CONFORMITY ASSESSMENT PROCEDURES
Article 8
1. The procedures for assessing the conformity of equipment, including where necessary the devices referred to in Article 1 (2), shall be as follows:
(a) equipment-group I and II, equipment-category M 1 and 1
The manufacturer or his authorized representative established in the Community must, in order to affix the CE marking, follow the CE type-examination procedure (referred to in Annex III), in conjunction with:
- the procedure relating to production quality assurance (referred to in Annex IV),
or
- the procedure relating to product verification (referred to in Annex V);
(b) Equipment-group I and II, equipment-category M 2 and 2
(i) In the case of internal combustion engines and electrical equipment in these groups and categories, the manufacturer or his authorized representative established in the Community shall, in order to affix the CE mark, follow the EC-type examination procedure (referred to in Annex III), in conjunction with:
- the procedure relating to conformity to type referred to in Annex VI, or
- the procedure relating to product quality assurance referred to in Annex VII;
(ii) in the case of other equipment in these groups and categories, the manufacturer or his authorized representative established in the Community must, in order to affix the CE mark, follow the procedure relating to internal control of production (referred to in Annex VIII)
and
communicate the dossier provided for in Annex VIII, paragraph 3, to a notified body, which shall acknowledge receipt of it as soon as possible and shall retain it.
(c) equipment-group II, equipment-category 3
The manufacturer or his authorized representative established in the Community must, in order to affix the CE marking, follow the procedure relating to internal control of production referred to n Annex VIII;
(d) equipment-groups I and II
In addition to the procedures referred to in paragraph 1(a), (b) and (c), the manufacturer or his authorized representative established in the Community may also, in order to affix the CE marking, follow the procedure relating to CE unit verification (referred to in Annex IX).
2. The provisions of 1(a) or 1(d) above shall be used for conformity assessment of autonomous protective systems.
3. The procedures referred to in paragraph 1 shall be applied in respect of components as referred to in Article 4 (2), with the exception of the affixing of the CE marking. A written attestation shall be issued by the manufacturer or his authorized representative established in the Community, declaring the conformity of the components with the provisions of this Directive which apply to them and stating their characteristics and how they must be incorporated into equipment or protective systems to assist compliance with the essential requirements applicable to finished equipment or protective systems.
4. In addition, the manufacturer or his authorized representative established in the Community may, in order to affix the CE marking, follow the procedure relating to internal control of production (referred to in Annex VIII) with regard to the safety aspects referred to in point 1.2.7 of Annex II.
5. Notwithstanding the previous paragraphs, the competent authorities may, on a duly justified request, authorize the placing on the market and putting into service on the territory of the Member State concerned of the equipment, protective systems and individual devices referred to in Article 1 (2) in respect of which the procedures referred to in the previous paragraphs have not been applied and the use of which is in the interests of protection.
6. Documents and correspondence relating to the procedures referred to in the abovementioned paragraphs shall be drawn up in one of the official languages of the Member States in which those procedures are being applied or in a language accepted by the notified body.
7. (a) Where the equipment, protective systems and devices referred to in Article 1(2) are subject to other Community Directives covering other aspects which also provide for the affixing of the CE marking referred to in Article 10, that marking shall indicate that the equipment, protective systems and devices referred to in Article 1(2) are also presumed to conform with the provisions of those other Directives.
(b) However, where one or more of those Directives allow the manufacturer, during a transitional period, to choose which arrangements to apply, the CE marking shall indicate conformity only with the Directives applied by the manufacturer. In this case, particulars of the said Directives, as published in the Official Journal of the European Communities, must be given in the documents, notices or instructions required by the Directives and accompanying the equipment, protective systems and devices referred to in Article 1(2).
Article 9
1. Member States shall notify the Commission and the other Member States of the bodies which they have appointed to carry out the procedures referred to in Article 8, together with the specific tasks which these bodies have been appointed to carry out and the identification numbers assigned to them beforehand by the Commission.
The Commission shall publish in the Official Journal of the European Communities a list of the notified bodies, with their identification numbers and the tasks for which they have been notified. The Commission shall ensure that this list is kept up to date.
2. Member States shall apply the criteria laid down in Annex XI in assessing the bodies to be indicated in such notification. Bodies meeting the assessment criteria laid down in the relative harmonized standards shall be presumed to fulfil those criteria.
3. A Member State which has approved a body must withdraw its notification if it finds that the body no longer meets the criteria referred to in Annex XI. It shall immediately inform the Commission and the other Member States accordingly.
Chapter III. CE CONFORMITY MARKING
Article 10
1. The CE conformity marking shall consist of the initials "CE". The form of the marking to be used is shown in Annex X. The CE marking shall be followed by the identification number of the notified body where such body is involved in the production control stage.
2. The CE marking shall be affixed distinctly, visibly, legibly and indelibly to equipment, protective systems and devices referred to in Article 1(2), supplementary to the provisions of point 1.0.5. of Annex II.
3. The affixing of markings on the equipment, protective systems or devices referred to in Article 1(2) which are likely to deceive third parties as to the meaning and form of the CE marking shall be prohibited. Any other marking may be affixed to the equipment, protective systems or devices referred to in Article 1(2), provided that the visibility and legibility of the CE marking is not thereby reduced.
Article 11
Without prejudice to Article 7:
(a) where a Member State establishes that the CE marking has been incorrectly affixed, the manufacturer or his authorized representative established within the Community shall be obliged to bring the product into conformity as regards the provisions concerning the CE marking and to end the infringement under the conditions imposed by the Member State;
(b) in the event of continuing non-conformity, the Member State must take all appropriate measures to restrict or prohibit the placing on the market of the product in question or to ensure that it is withdrawn from the market in accordance with the procedures laid down in Article 7.
Chapter IV. FINAL PROVISIONS
Article 12
Any decision taken pursuant to this Directive which restricts or prohibits the placing on the market and/or the putting into service or requires the withdrawal from the market of equipment, a protective system, or a device referred to in Article 1 (2) shall state the exact grounds on which it is based. Such a decision shall be notified forthwith to the party concerned, who shall at the same time be informed of the legal remedies available to him under the laws in force in the Member State concerned and of the time limits to which such remedies are subject.
Article 13
Member States shall ensure that all the parties involved in the application of the Directive are bound to observe confidentiality in respect of all information obtained in the performance of carrying out their tasks. This does not affect the obligations of the Member States and of the notified bodies regarding reciprocal information and the dissemination of warnings.
Article 14
1. Directive 76/117/EEC, Directive 79/196/EEC <*> and Directive 82/130/EEC shall be repealed as from 1 July 2003.

2. EC certificates of conformity to the harmonized standards obtained in accordance with the procedures laid down in the Directives referred to in paragraph 1 shall continue to be valid until 30 June 2003 unless they expire before that date. Their validity shall continue to be limited to the harmonized standards indicated in the aforementioned Directives.
3. Member States shall take the necessary action to ensure that the notified bodies which are responsible pursuant to Article 8 (1) to (4) for the assessment of the conformity of electrical equipment placed on the market before 1 July 2003 take account of the results of tests and verifications already carried out under the Directives referred to in paragraph 1.
Article 15
1. Member States shall adopt and publish the laws, regulations and administrative provisions necessary to comply with this Directive before 1 September 1995. They shall forthwith inform the Commission thereof.
The Member States shall apply these measures with effect from 1 March 1996.
When Member States adopt the measures referred to in the first subparagraph, they shall contain a reference to this Directive or shall be accompanied by such reference at the time of their official publication. The methods of making such reference shall be laid down by Member States.
2. However, Member States shall allow the placing on the market and the putting into service of equipment and protective systems conforming with the national regulations in force in their territory at the date of adoption of this Directive for the period until 30 June 2003.
Article 16
This Directive is addressed to the Member States.

Annex I
CRITERIA
DETERMINING THE CLASSIFICATION OF EQUIPMENT-GROUPS
INTO CATEGORIES
1. Equipment-group I
(a) Category M 1 comprises equipment designed and, where necessary, equipped with additional special means of protection to be capable of functioning in conformity with the operational parameters established by the manufacturer and ensuring a very high level of protection.
Equipment in this category is intended for use in underground parts of mines as well as those parts of surface installations of such mines endangered by firedamp and/or combustible dust.
Equipment in this category is required to remain functional, even in the event of rare incidents relating to equipment, with an explosive atmosphere present, and is characterized by means of protection such that:
- either, in the event of failure of one means of protection, at least an independent second means provides the requisite level of protection,
- or the requisite level of protection is assured in the event of two faults occurring independently of each other.
Equipment in this category must comply with the supplementary requirements referred to in Annex II, 2.0.1.
(b) Category M 2 comprises equipment designed to be capable of functioning in conformity with the operational parameters established by the manufacturer and ensuring a high level of protection.
Equipment in this category is intended for use in underground parts of mines as well as those parts of surface installations of such mines likely to be endangered by firedamp and/or combustible dust.
This equipment is intended to be de-energized in the event of an explosive atmosphere.
The means of protection relating to equipment in this category assure the requisite level of protection during normal operation and also in the case of more severe operating conditions, in particular those arising from rough handling and changing environmental conditions.
Equipment in this category must comply with the supplementary requirements referred to in Annex II, 2.0.2.
2. Equipment-group II
(a) Category 1 comprises equipment designed to be capable of functioning in conformity with the operational parameters established by the manufacturer and ensuring a very high level of protection.
Equipment in this category is intended for use in areas in which explosive atmospheres caused by mixtures of air and gases, vapours or mists or by air/dust mixtures are present continuously, for long periods or frequently.
Equipment in this category must ensure the requisite level of protection, even in the event of rare incidents relating to equipment, and is characterized by means of protection such that:
- either, in the event of failure of one means of protection, at least an independent second means provides the requisite level of protection,
- or the requisite level of protection is assured in the event of two faults occurring independently of each other.
Equipment in this category must comply with the supplementary requirements referred to in Annex II, 2.1.
(b) Category 2 comprises equipment designed to be capable of functioning in conformity with the operational parameters established by the manufacturer and of ensuring a high level of protection.
Equipment in this category is intended for use in areas in which explosive atmospheres caused by gases, vapours, mists or air/dust mixtures are likely to occur occasionally.
The means of protection relating to equipment in this category ensure the requisite level of protection, even in the event of frequently occurring disturbances or equipment faults which normally have to be taken into account.
Equipment in this category must comply with the supplementary requirements referred to in Annex II, 2.2.
(c) Category 3 comprises equipment designed to be capable of functioning in conformity with the operating parameters established by the manufacturer and ensuring a normal level of protection.
Equipment in this category is intended for use in areas in which explosive atmospheres caused by gases, vapours, mists, or air/dust mixtures are unlikely to occur or, if they do occur, are likely to do so only infrequently and for a short period only.
Equipment in this category ensures the requisite level of protection during normal operation.
Equipment in this category must comply with the supplementary requirements referred to in Annex II, 2.3.
Annex II
ESSENTIAL HEALTH AND SAFETY REQUIREMENTS RELATING
TO THE DESIGN AND CONSTRUCTION OF EQUIPMENT AND PROTECTIVE
SYSTEMS INTENDED FOR USE IN POTENTIALLY EXPLOSIVE
ATMOSPHERES
Preliminary observations
A. Technological knowledge, which can change rapidly, must be taken into account as far as possible and be utilized immediately.
B. For the devices referred to in Article 1 (2), the essential requirements shall apply only in so far as they are necessary for the safe and reliable functioning and operation of those devices with respect to the risks of explosion.
1. COMMON REQUIREMENTS FOR EQUIPMENT AND PROTECTIVE SYSTEMS
1.0. General requirements
1.0.1. Principles of integrated explosion safety
Equipment and protective systems intended for use in potentially explosive atmospheres must be designed from the point of view of integrated explosion safety.
In this connection, the manufacturer must take measures:
- above all, if possible, to prevent the formation of explosive atmospheres which may be produced or released by equipment and by protective systems themselves,
- to prevent the ignition of explosive atmospheres, taking into account the nature of every electrical and non-electrical source of ignition,
- should an explosion nevertheless occur which could directly or indirectly endanger persons and, as the case may be, domestic animals or property, to halt it immediately and/or to limit the range of explosion flames and explosion pressures to a sufficient level of safety.
1.0.2. Equipment and protective systems must be designed and manufactured after due analysis of possible operating faults in order as far as possible to preclude dangerous situations.
Any misuse which can reasonably be anticipated must be taken into account.
1.0.3. Special checking and maintenance conditions
Equipment and protective systems subject to special checking and maintenance conditions must be designed and constructed with such conditions in mind.
1.0.4. Surrounding area conditions
Equipment and protective systems must be so designed and constructed as to be capable of coping with actual or foreseeable surrounding area conditions.
1.0.5. Marking
All equipment and protective systems must be marked legibly and indelibly with the following minimum particulars;
- name and address of the manufacturer,
- CE marking (see Annex X, point A),
- designation of series or type,
- serial number, if any,
- year of construction,
- the specific marking of explosion protection followed by the symbol of the equipment group and category,
- for equipment-group II, the letter "G" (concerning explosive atmospheres caused by gases, vapours or mists),
and/or
the letter "D" (concerning explosive atmospheres caused by dust).
Furthermore, where necessary, they must also be marked with all information essential to their safe use.
1.0.6. Instructions
(a) All equipment and protective systems must be accompanied by instructions, including at least the following particulars:
- a recapitulation of the information with which the equipment or protective system is marked, except for the serial number (see 1.0.5.), together with any appropriate additional information to facilitate maintenance (e.g. address of the importer, repairer, etc.);
- instructions for safe:
- putting into service,
- use,
- assembling and dismantling,
- maintenance (servicing and emergency repair),
- installation,
- adjustment;
- where necessary, an indication of the danger areas in front of pressure-relief devices;
- where necessary, training instructions;
- details which allow a decision to be taken beyond any doubt as to whether an item of equipment in a specific category or a protective system can be used safely in the intended area under the expected operating conditions;
- electrical and pressure parameters, maximum surface temperatures and other limit values;
- where necessary, special conditions of use, including particulars of possible misuse which experience has shown might occur;
- where necessary, the essential chracteristics of tools which may be fitted to the equipment or protective system.
(b) The instructions must be drawn up in one of the Community languages by the manufacturer or his authorized representative established in the Community.
On being put into service, all equipment and protective systems must be accompanied by a translation of the instructions in the language or languages of the country in which the equipment or protective system is to be used and by the instructions in the original language.
This translation must be made by either the manufacturer or his authorized representative established in the Community or the person introducing the equipment or protective system into the language area in question.
By way of derogation from this requirement, the maintenance instructions for use by the specialist personnel employed by the manufacturer or his authorized representative established in the Community may be drawn up in a single Community language understood by that personnel.
(c) The instructions must contain the drawings and diagrams necessary for the putting into service, maintenance, inspection, checking of correct operation and, where appropriate, repair of the equipment or protective system, together with all useful instructions, in particular with regard to safety.
(d) Literature describing the equipment or protective system must not contradict the instructions with regard to safety aspects.
1.1. Selection of materials
1.1.1. The materials used for the construction of equipment and protective systems must not trigger off an explosion, taking into account foreseeable operational stresses.
1.1.2. Within the limits of the operating conditions laid down by the manufacturer, it must not be possible for a reaction to take place between the materials used and the constituents of the potentially explosive atmosphere which could impair explosion protection.
1.1.3. Materials must be so selected that predictable changes in their characteristics and their compatibility in combination with other materials will not lead to a reduction in the protection afforded; in particular, due account must be taken of the material's corrosion and wear resistance, electrical conductivity, mechanical strength, ageing resistance and the effects of temperature variations.
1.2. Design and Construction
1.2.1. Equipment and protective systems must be designed and constructed with due regard to technological knowledge of explosion protection so that they can be safely operated throughout their foreseeable lifetime.
1.2.2. Components to be incorporated into or used as replacements in equipment and protective systems must be so designed and constructed that they function safely for their intended purpose of explosion protection when they are installed in accordance with the manufacturer's instructions.
1.2.3. Enclosed structures and prevention of leaks
Equipment which may release flammable gases or dusts must wherever possible employ enclosed structures only.
If equipment contains openings or non-tight joints, these must as far as possible be designed in such a way that releases of gases or dusts cannot give rise to explosive atmospheres outside the equipment.
Points where materials are introduced or drawn off must, as far as possible, be designed and equipped so as to limit releases of flammable materials during filling or draining.
1.2.4. Dust deposits
Equipment and protective systems which are intended to be used in areas exposed to dust must be so designed that deposit dust on their surfaces is not ignited.
In general, dust deposits must be limited where possible. Equipment and protective systems must be easily cleanable.
The surface temperatures of equipment parts must be kept well below the glow temperature of the deposit dust.
The thickness of deposit dust must be taken into consideration and, if appropriate, means must be taken to limit the temperature in order to prevent a heat build up.
1.2.5. Additional means of protection
Equipment and protective systems which may be exposed to certain types of external stresses must be equipped, where necessary, with additional means of protection.
Equipment must withstand relevant stresses, without adverse effect on explosion protection.
1.2.6. Safe opening
If equipment and protective systems are in a housing or a locked container forming part of the explosion protection itself, it must be possible to open such housing or container only with a special tool or by means of appropriate protection measures.
1.2.7. Protection against other hazards
Equipment and protective systems must be so designed and manufactured as to:
(a) avoid physical injury or other harm which might be caused by direct or indirect contact;
(b) assure that surface temperatures of accessible parts or radiation which would cause a danger, are not produced;
(c) eliminate non-electrical dangers which are revealed by experience;
(d) assure that foreseeable conditions of overload do not give rise to dangerous situations.
Where, for equipment and protective systems, the risks referred to in this paragraph are wholly or partly covered by other Community Directives, this Directive shall not apply or shall cease to apply in the case of such equipment and protective systems and of such risks upon application of those specific Directives.
1.2.8. Overloading of equipment
Dangerous overloading of equipment must be prevented at the design stage by means of integrated measurement, regulation and control devices, such as over-current cut-off switches, temperature limiters, differential pressure switches, flowmeters, time-lag relays, overspeed monitors and/or similar types of monitoring devices.
1.2.9. Flameproof enclosure systems
If parts which can ignite an explosive atmosphere are placed in an enclosure, measures must be taken to ensure that the enclosure withstands the pressure developed during an internal explosion of an explosive mixture and prevents the transmission of the explosion to the explosive atmosphere surrounding the enclosure.
1.3. Potential ignition sources
1.3.1. Hazards arising from different ignition sources
Potential ignition sources such as sparks, flames, electric arcs, high surface temperatures, acoustic energy, optical radiation, electromagnetic waves and other ignition sources must not occur.
1.3.2. Hazards arising from static electricity
Electrostatic charges capable of resulting in dangerous discharges must be prevented by means of appropriate measures.
1.3.3. Hazards arising from stray electric and leakage currents
Stray electric and leakage currents in conductive equipment parts which could result in, for example, the occurrence of dangerous corrosion, overheating of surfaces or sparks capable of provoking an ignition must be prevented.
1.3.4. Hazards arising from overheating
Overheating caused by friction or impacts occurring, for example, between materials and parts in contact with each other while rotating or through the intrusion of foreign bodies must, as far as possible, be prevented at the design stage.
1.3.5. Hazards arising from pressure compensation operations
Equipment and protective systems must be so designed or fitted with integrated measuring, control and regulation devices that pressure compensations arising from them do not generate shock waves or compressions which may cause ignition.
1.4. Hazards arising from external effects
1.4.1. Equipment and protective systems must be so designed and constructed as to be capable of performing their intended function in full safety, even in changing environmental conditions and in the presence of extraneous voltages, humidity, vibrations, contamination and other external effects, taking into account the limits of the operating conditions established by the manufacturer.
1.4.2. Equipment parts used must be appropriate to the intended mechanical and thermal stresses and capable of withstanding attack by existing or foreseeable aggressive substances.
1.5. Requirements in respect of safety-related devices
1.5.1. Safety devices must function independently of any measurement and/or control devices required for operation.
As far as possible, failure of a safety device must be detected sufficiently rapidly by appropriate technical means to ensure that there is only very little likelihood that dangerous situations will occur.
The fail-safe principle is to be applied in general.
Safety-related switching must in general directly actuate the relevant control devices without intermediate software command.
1.5.2. In the event of a safety device failure, equipment and/or protective systems shall, wherever possible, be secured.
1.5.3. Emergency stop controls of safety devices must, as far as possible, be fitted with restart lockouts. A new start command may take effect on normal operation only after the restart lockouts have been intentionally reset.
1.5.4. Control and display units
Where control and display units are used, they must be designed in accordance with ergonomic principles in order to achieve the highest possible level of operating safety with regard to the risk of explosion.
1.5.5. Requirements in respect of devices with a measuring function for explosion protection.
In so far as they relate to equipment used in explosive atmospheres, devices with a measuring function must be designed and constructed so that they can cope with foreseeable operating requirements and special conditions of use.
1.5.6. Where necessary, it must be possible to check the reading accuracy and serviceability of devices with a measuring function.
1.5.7. The design of devices with a measuring function must incorporate a safety factor which ensures that the alarm threshold lies far enough outside the explosion and/or ignition limits of the atmospheres to be registered, taking into account, in particular, the operating conditions of the installation and possible aberrations in the measuring system.
1.5.8. Risks arising from software
In the design of software-controlled equipment, protective systems and safety devices, special account must be taken of the risks arising from faults in the programme.
1.6. Integration of safety requirements
relating to the system
1.6.1. Manual override must be possible in order to shut down the equipment and protective systems incorporated within automatic processes which deviate from the intended operating conditions, provided that this does not compromise safety.
1.6.2. When the emergency shutdown system is actuated, accumulated energy must be dispersed as quickly and as safely as possible or isolated so that it no longer constitutes a hazard.
This does not apply to electrochemically-stored energy.
1.6.3. Hazards arising from power failure
Where equipment and protective systems can give rise to a spread of additional risks in the event of a power failure, it must be possible to maintain them in a safe state of operation independently of the rest of the installation.
1.6.4. Hazards arising from connections
Equipment and protective systems must be fitted with suitable cable and conduit entries.
When equipment and protective systems are intended for use in combination with other equipment and protective systems, the interface must be safe.
1.6.5. Placing of warning devices as parts of equipment
Where equipment or protective systems are fitted with detection or alarm devices for monitoring the occurrence of explosive atmospheres, the necessary instructions must be provided to enable them to be provided at the appropriate places.
2. SUPPLEMENTARY REQUIREMENTS IN RESPECT OF EQUIPMENT
2.0. Requirements applicable to equipment
in category M of equipment-group I
2.0.1. Requirements applicable to equipment in category M 1 of equipment-group I
2.0.1.1. Equipment must be so designed and constructed that sources of ignition do not become active, even in the event of rare incidents relating to equipment.
Equipment must be equipped with means of protection such that:
- either, in the event of failure of one means of protection, at least an independent second means provides the requisite level of protection,
- or, the requisite level of protection is ensured in the event of two faults occurring independently of each other.
Where necessary, this equipment must be equipped with additional special means of protection.
It must remain functional with an explosive atmosphere present.
2.0.1.2. Where necessary, equipment must be so constructed that no dust can penetrate it.
2.0.1.3. The surface temperatures of equipment parts must be kept clearly below the ignition temperature of the foreseeable air/dust mixtures in order to prevent the ignition of suspended dust.
2.0.1.4. Equipment must be so designed that the opening of equipment parts which may be sources of ignition is possible only under non-active or intrinsically safe conditions. Where it is not possible to render equipment non-active, the manufacturer must affix a warning label to the opening part of the equipment.
If necessary, equipment must be fitted with appropriate additional interlocking systems.
2.0.2. Requirements applicable to equipment in category M 2 of equipment-group I
2.0.2.1. Equipment must be equipped with means of protection ensuring that sources of ignition do not become active during normal operation, even under more severe operating conditions, in particular those arising from rough handling and changing environmental conditions.
The equipment is intended to be de-energized in the event of an explosive atmosphere.
2.0.2.2. Equipment must be so designed that the opening of equipment parts which may be sources of ignition is possible only under non-active conditions or via appropriate interlocking systems. Where it is not possible to render equipment non-active, the manufacturer must affix a warning label to the opening part of the equipment.
2.0.2.3. The requirements regarding explosion hazards arising from dust applicable to category M 1 must be applied.
2.1. Requirements applicable to equipment
in category 1 of equipment-group II
2.1.1. Explosive atmospheres caused by gases, vapours or mists
2.1.1.1. Equipment must be so designed and constructed that sources of ignition do not become active, even in event of rare incidents relating to equipment.
It must be equipped with means of protection such that:
- either, in the event of failure of one means of protection, at least an independent second means provides the requisite level of protection,
- or, the requisite level of protection is ensured in the event of two faults occurring independently of each other.
2.1.1.2. For equipment with surfaces which may heat up, measures must be taken to ensure that the stated maximum surface temperatures are not exceeded even in the most unfavourable circumstances.
Temperature rises caused by heat build-ups and chemical reactions must also be taken into account.
2.1.1.3. Equipment must be so designed that the opening of equipment parts which might be sources of ignition is possible only under non-active or intrinsically safe conditions. Where it is not possible to render equipment non-active, the manufacturer must affix a warning label to the opening part of the equipment.
If necessary, equipment must be fitted with appropriate additional interlocking systems.
2.1.2. Explosive atmospheres caused by air/dust mixtures
2.1.2.1. Equipment must be so designed and constructed that ignition of air/dust mixtures does not occur even in the event of rare incidents relating to equipment.
It must be equipped with means of protection such that
- either, in the event of failure of one means of protection, at least an independent second means provides the requisite level of protection,
- or, the requisite level of protection is ensured in the event of two faults occurring independently of each other.
2.1.2.2. Where necessary, equipment must be so designed that dust can enter or escape from the equipment only at specifically designated points.
This requirement must also be met by cable entries and connecting pieces.
2.1.2.3. The surface temperatures of equipment parts must be kept well below the ignition temperature of the foreseeable air/dust mixtures in order to prevent the ignition of suspended dust.
2.1.2.4. With regard to the safe opening of equipment parts, requirement 2.1.1.3 applies.
2.2. Requirements for category 2 of equipment-group II
2.2.1. Explosive atmospheres caused by gases, vapours or mists
2.2.1.1. Equipment must be so designed and constructed as to prevent ignition sources arising, even in the event of frequently occurring disturbances or equipment operating faults, which normally have to be taken into account.
2.2.1.2. Equipment parts must be so designed and constructed that their stated surface temperatures are not exceeded, even in the case of risks arising from abnormal situations anticipated by the manufacturer.
2.2.1.3. Equipment must be so designed that the opening of equipment parts which might be sources of ignition is possible only under non-active conditions or via appropriate interlocking systems. Where it is not possible to render equipment non-active, the manufacturer must affix a warning label to the opening part of the equipment.
2.2.2. Explosive atmospheres caused by air/dust mixtures
2.2.2.1. Equipment must be designed and constructed so that ignition of air/dust mixtures is prevented, even in the event of frequently occurring disturbances or equipment operating faults which normally have to be taken into account.
2.2.2.2. With regard to surface temperatures, requirement 2.1.2.3 applies.
2.2.2.3. With regard to protection against dust, requirement 2.1.2.2 applies.
2.2.2.4. With regard to the safe opening of equipment parts, requirement 2.2.1.3 applies.
2.3. Requirements applicable to equipment
in category 3 of equipment-group II
2.3.1. Explosive atmospheres caused by gases, vapours or mists
2.3.1.1. Equipment must be so designed and constructed as to prevent foreseeable ignition sources which can occur during normal operation.
2.3.1.2. Surface temperatures must not exceed the stated maximum surface temperatures under intended operating conditions. Higher temperatures in exceptional circumstances may be allowed only if the manufacturer adopts special additional protective measures.
2.3.2. Explosive atmospheres caused by air/dust mixtures
2.3.2.1. Equipment must be so designed and constructed that air/dust mixtures cannot be ignited by foreseeable ignition sources likely to exist during normal operation.
2.3.2.2. With regard to surface temperatures, requirement 2.1.2.3 applies.
2.3.2.3. Equipment, including cable entries and connecting pieces, must be so constructed that, taking into account the size of its particles, dust can neither develop explosive mixtures with air nor form dangerous accumulations inside the equipment.
3. SUPPLEMENTARY REQUIREMENTS IN RESPECT OF PROTECTIVE
SYSTEMS
3.0. General requirements
3.0.1. Protective systems must be dimensioned in such a way as to reduce the effects of an explosion to a sufficient level of safety.
3.0.2. Protective systems must be designed and capable of being positioned in such a way that explosions are prevented from spreading through dangerous chain reactions or flashover and incipient explosions do not become detonations.
3.0.3. In the event of a power failure, protective systems must retain their capacity to function for a period sufficient to avoid a dangerous situation.
3.0.4. Protective systems must not fail due to outside interference.
3.1. Planning and design
3.1.1. Characteristics of materials
With regard to the characteristics of materials, the maximum pressure and temperature to be taken into consideration at the planning stage are the expected pressure during an explosion occurring under extreme operating conditions and the anticipated heating effect of the flame.
3.1.2. Protective systems designed to resist or contain explosions must be capable of withstanding the shock wave produced without losing system integrity.
3.1.3. Accessories connected to protective systems must be capable of withstanding the expected maximum explosion pressure without losing their capacity to function.
3.1.4. The reactions caused by pressure in peripheral equipment and connected pipe-work must be taken into consideration in the planning and design of protective systems.
3.1.5. Pressure-relief systems
If it is likely that stresses on protective systems will exceed their structural strength, provision must be made in the design for suitable pressure-relief devices which do not endanger persons in the vicinity.
3.1.6. Explosion suppression systems
Explosion suppression systems must be so planned and designed that they react to an incipient explosion at the earliest possible stage in the event of an incident and counteract it to best effect, with due regard to the maximum rate of pressure increase and the maximum explosion pressure.
3.1.7. Explosion decoupling systems
Decoupling systems intended to disconnect specific equipment as swiftly as possible in the event of incipient explosions by means of appropriate devices must be planned and designed so as to remain proof against the transmission of internal ignition and to retain their mechanical strength under operating conditions.
3.1.8. Protective systems must be capable of being integrated into a circuit with a suitable alarm threshold so that, if necessary, there is cessation of product feed and output and shutdown of equipment parts which can no longer function safely.
Annex III
MODULE EC-TYPE EXAMINATION
1. This module describes that part of the procedure by which a notified body ascertains and attests that a specimen representative of the production envisaged meets the relevant applicable provisions of the Directive.
2. The application for the EC-type examination shall be lodged by the manufacturer or his authorized representative established within the Community with a notified body of his choice.
The application shall include:
- the name and address of the manufacturer and, if the application is lodged by the authorized representative, his name and address in addition;
- a written declaration that the same application has not been lodged with any other notified body;
- the technical documentation, as described in point 3.
The applicant shall place at the disposal of the notified body a specimen representative of the production envisaged and hereinafter called "type". The notified body may request further specimens if needed for carrying out the test programme.
3. The technical documentation shall enable the conformity of the product with the requirements of the Directive to be assessed. It shall, to the extent necessary for such assessment, cover the design, manufacture and operation of the product and shall to that extent contain:
- a general type-description;
- design and manufacturing drawings and layouts of components, sub-assemblies, circuits, etc.;
- descriptions and explanations necessary for the understanding of said drawings and layouts and the operation of the product;
- a list of the standards referred to in Article 5, applied in full or in part, and descriptions of the solutions adopted to meet the essential requirements of the Directive where the standards referred to in Article 5 have not been applied;
- results of design calculations made, examinations carried out, etc.;
- test reports.
4. The notified body shall:
4.1. examine the technical documentation, verify that the type has been manufactured in conformity with the technical documentation and identify the elements which have been designed in accordance with the relevant provisions of the standards referred to in Article 5, as well as the components which have been designed without applying the relevant provisions of those standards;
4.2. perform or have performed the appropriate examinations and necessary tests to check whether the solutions adopted by the manufacturer meet the essential requirements of the Directive where the standards referred to in Article 5 have not been applied;
4.3. perform or have performed the appropriate examinations and necessary tests to check whether these have actually been applied, where the manufacturer has chosen to apply the relevant standards;
4.4. agree with the applicant the location where the examinations and necessary tests shall be carried out.
5. Where the type meets the provisions of the Directive, the notified body shall issue an EC-type-examination certificate to the applicant. The certificate shall contain the name and address of the manufacturer, conclusions of the examination and the necessary data for identification of the approved type.
A list of the significant parts of the technical documentation shall be annexed to the certificate and a copy kept by the notified body.
If the manufacturer or his authorized representative established in the Community is denied a type certification, the notified body shall provide detailed reasons for such denial.
Provision shall be made for an appeals procedure.
6. The applicant shall inform the notified body which holds the technical documentation concerning the EC-type-examination certificate of all modifications to the approved equipment or protective system which must receive further approval where such changes may affect conformity with the essential requirements or with the prescribed conditions for use of the product. This further approval is given in the form of an addition to the original EC-type-examination certificate.
7. Each notified body shall communicate to the other notified bodies the relevant information concerning the EC-type-examination certificates and additions issued and withdrawn.
8. The other notified bodies may receive copies of the EC-type-examination certificates and/or their additions. The annexes to the certificates shall be kept at the disposal of the other notified bodies.
9. The manufacturer or his authorized representative established in the Community shall keep with the technical documentation copies of EC-type-examination certificates and their additions for a period ending at least 10 years after the last equipment or protective system was manufactured.
Where neither the manufacturer nor his authorized representative is established within the Community, the obligation to keep the technical documentation available shall be the responsibility of the person who places the product on the Community market.
Annex IV
MODULE: PRODUCTION QUALITY ASSURANCE
1. This module describes the procedure whereby the manufacturer who satisfies the obligations of point 2 ensures and declares that the products concerned are in conformity with the type as described in the EC-type-examination certificate and satisfy the requirements of the Directive which apply to them. The manufacturer, or his authorized representative established in the Community, shall affix the CE marking to each piece of equipment and draw up a written declaration of conformity. The CE marking shall be accompanied by the identification number of the notified body responsible for EC monitoring, as specified in Section 4.
2. The manufacturer shall operate an approved quality system for production, final equipment inspection and testing as specified in Section 3 and shall be subject to monitoring as specified in Section 4.
3. Quality system
3.1. The manufacturer shall lodge an application for assessment of his quality system with a notified body of his choice, for the equipment concerned.
The application shall include:
- all relevant information for the product category envisaged;
- the documentation concerning the quality system;
- technical documentation on the approved type and a copy of the EC-type-examination certificate.
3.2. The quality system shall ensure compliance of the equipment with the type as described in the EC-type-examination certificate and with the requirements of the Directive which apply to them.
All the elements, requirements and provisions adopted by the manufacturer shall be documented in a systematic and orderly manner in the form of written policies, procedures and instructions. The quality system documentation must permit a consistent interpretation of quality programmes, plans, manuals and records.
It shall contain, in particular, an adequate description of
- the quality objectives and the organizational structure, responsibilities and powers of the management with regard to equipment quality;
- the manufacturing, quality control and quality assurance techniques, processes and systematic actions which will be used;
- the examinations and tests which will be carried out before, during and after manufacture and the frequency with which they will be carried out;
- the quality records, such as inspection reports and test data, calibration data, reports on the qualifications of the personnel concerned, etc.;
- the means to monitor the achievement of the required equipment quality and the effective operation of the quality system.
3.3. The notified body shall assess the quality system to determine whether it satisfies the requirements referred to in Section 3.2. It shall presume conformity with these requirements in respect of quality systems which implement the relevant harmonized standard. The auditing team shall have at least one member with experience of evaluation in the equipment technology concerned. The evaluation procedure shall include an inspection visit to the manufacturer's premises. The decision shall be notified to the manufacturer. The notification shall contain the conclusions of the examination and the reasoned assessment decision.
3.4. The manufacturer shall undertake to fulfil the obligations arising out of the quality system as approved and to uphold the system so that it remains adequate and efficient.
The manufacturer or his authorized representative shall inform the notified body which has approved the quality system of any intended updating of the quality system.
The notified body shall evaluate the modifications proposed and decide whether the amended quality system will still satisfy the requirements referred to in Section 3.2 or whether a re-assessment is required.
It shall notify its decision to the manufacturer. The notification shall contain the conclusions of the examination and the reasoned assessment decision.
4. Surveillance under the responsibility of the notified body
4.1. The purpose of surveillance is to make sure that the manufacturer duly fulfils the obligations arising out of the approved quality system.
4.2. The manufacturer shall, for inspection purposes, allow the notified body access to the manufacture, inspection, testing and storage premises and shall provide it with all necessary information, in particular
- the quality system documentation
- the quality records, such as inspection reports and test data, calibration data, reports on the qualifications of the personnel concerned, etc.
4.3. The notified body shall periodically carry out audits to ensure that the manufacturer maintains and applies the quality system and shall provide an audit report to the manufacturer.
4.4. Furthermore, the notified body may pay unexpected visits to the manufacturer. During such visits, the notified body may carry out tests, or arrange for tests to be carried out, to check that the quality system is functioning correctly, if necessary. The notified body shall provide the manufacturer with a visit report and, if a test has taken place, with a test report.
5. The manufacturer shall, for a period ending at least 10 years after the last piece of equipment was manufactured, keep at the disposal of the national authorities:
- the documentation referred to in the second indent of Section 3.1;
- the updating referred to in the second paragraph of Section 3.4;
- the decisions and reports from the notified body which are referred to in Section 3.4, last paragraph, Section 4.3 and Section 4.4.
6. Each notified body shall apprise the other notified bodies of the relevant information concerning the quality system approvals issued and withdrawn.
Annex V
MODULE: PRODUCT VERIFICATION
1. This module describes the procedure whereby a manufacturer or his authorized representative established within the Community checks and attests that the equipment subject to the provisions of point 3 are in conformity with the type as described in the EC-type-examination certificate and satisfy the relevant requirements of the Directive.
2. The manufacturer shall take all measures necessary to ensure that the manufacturing process guarantees conformity of the equipment with the type as described in the EC-type-examination certificate and with the requirements of the Directive which apply to them. The manufacturer or his authorized representative established in the Community shall affix the CE marking to each piece of equipment and shall draw up a declaration of conformity.
3. The notified body shall carry out the appropriate examinations and tests in order to check the conformity of the equipment, protective system or device referred to in Article 1 (2), with the relevant requirements of the Directive, by examining and testing every product as specified in Section 4.
The manufacturer or his authorized representative shall keep a copy of the declaration of conformity for a period ending at least 10 years after the last piece of equipment was manufactured.
4. Verification by examination and testing of each piece of equipment.
4.1. All equipment shall be individually examined and appropriate tests as set out in the relevant standard(s) referred to in Article 5 or equivalent tests shall be carried out in order to verify their conformity with the type as described in the EC-type-examination certificate and the relevant requirements of the Directive.
4.2. The notified body shall affix or have affixed its identification number to each approved item of equipment and shall draw up a written certificate of conformity relating to the tests carried out.
4.3. The manufacturer or his authorized representative shall ensure that he is able to supply the notified body's certificates of conformity on request.
Annex VI
MODULE: CONFORMITY TO TYPE
1. This module describes that part of the procedure whereby the manufacturer or his authorized representative established within the Community ensures and declares that the equipment in question is in conformity with the type as described in the EC-type-examination certificate and satisfies the requirements of the Directive applicable to it. The manufacturer or his authorized representative established within the Community shall affix the CE marking to each piece of equipment and draw up a written declaration of conformity.
2. The manufacturer shall take all measures necessary to ensure that the manufacturing process assures compliance of the manufactured equipment with the type as described in the EC-type-examination certificate and with the relevant requirements of the Directive.
3. The manufacturer or his authorized representative shall keep a copy of the declaration of conformity for a period ending at least 10 years after the last piece of equipment was manufactured. Where neither the manufacturer nor his authorized representative is established within the Community, the obligation to keep the technical documentation available shall be the responsibility of the person who places the equipment or protective system on the Community market.
For each piece of equipment manufactured, tests relating to the anti-explosive protection aspects of the product shall be carried out by the manufacturer or on his behalf. The tests shall be carried out under the responsibility of a notified body, chosen by the manufacturer.
On the responsibility of the notified body, the manufacturer shall affix the former's identification number during the manufacturing process.
Annex VII
MODULE: PRODUCT QUALITY ASSURANCE
1. This module describes the procedure whereby the manufacturer who satisfies the obligations of Section 2 ensures and declares that the equipment is in conformity with the type as described in the EC-type-examination certificate. The manufacturer or his authorized representative established within the Community shall affix the CE marking to each product and draw up a written declaration of conformity. The CE marking shall be accompanied by the identification number of the notified body responsible for surveillance as specified in Section 4.
2. The manufacturer shall operate an approved quality system for the final inspection and testing of equipment as specified in Section 3 below and shall be subject to surveillance as specified in Section 4 below.
3. Quality system
3.1. The manufacturer shall lodge an application for assessment of his quality system for the equipment, with a notified body of his choice.
The application shall include:
- all relevant information for the product category envisaged;
- documentation on the quality system;
- technical documentation on the approved type and a copy of the EC-type-examination certificate.
3.2. Under the quality system, each piece of equipment shall be examined and appropriate tests as set out in the relevant standard(s) referred to in Article 5 or equivalent tests shall be carried out in order to ensure its conformity with the relevant requirements of the Directive. All the elements, requirements and provisions adopted by the manufacturer shall be documented in a systematic and orderly manner in the form of written policies, procedures and instructions. This quality system documentation must permit a consistent interpretation of the quality programmes, plans, manuals and records.
It shall contain, in particular, an adequate description of:
- the quality objectives and the organizational structure, responsibilities and powers of the management with regard to product quality;
- the examinations and tests which will be carried out after manufacture;
- the means to monitor the effective operation of the quality system;
- quality records, such as inspection reports and test data, calibration data, reports on the qualifications of the personnel concerned, etc.
3.3. The notified body shall assess the quality system to determine whether it satisfies the requirements referred to in Section 3.2. It shall presume conformity with these requirements in respect of quality systems which implement the relevant harmonized standard.
The auditing team shall have at least one member experienced as an assessor in the product technology concerned. The assessment procedure shall include an assessment visit to the manufacturer's premises.
The decision shall be notified to the manufacturer. The notification shall contain the conclusions of the examination and the reasoned assessment decision.
3.4. The manufacturer shall undertake to discharge the obligations arising from the quality system as approved and to maintain it in an appropriate and efficient manner.
The manufacturer or his authorized representative shall inform the notified body which has approved the quality system of any intended updating of the quality system.
The notified body shall evaluate the modifications proposed and decide whether the modified quality system will still satisfy the requirements referred to in Section 3.2 or whether a re-assessment is required.
It shall notify its decision to the manufacturer. The notification shall contain the conclusions of the examination and the reasoned assessment decision.
4. Surveillance under the responsibility of the notified body
4.1. The purpose of surveillance is to ensure that the manufacturer duly fulfils the obligations arising out of the approved quality system.
4.2. The manufacturer shall for inspection purposes allow the notified body access to the inspection, testing and storage premises and shall provide it with all necessary information, in particular:
- quality system documentation;
- technical documentation;
- quality records, such as inspection reports and test data, calibration data, reports on the qualifications of the personnel concerned, etc.
4.3. The notified body shall periodically carry out audits to ensure that the manufacturer maintains and applies the quality system and shall provide an audit report to the manufacturer.
4.4. Furthermore, the notified body may pay unexpected visits to the manufacturer. At the time of such visits, the notified body may carry out tests or arrange for tests to be carried out in order to check the proper functioning of the quality system, where necessary; it shall provide the manufacturer with a visit report and, if a test has been carried out, with a test report.
5. The manufacturer shall, for a period ending at least 10 years after the last piece of equipment was manufactured, keep at the disposal of the national authorities:
- the documentation referred to in the third indent of Section 3.1;
- the updating referred to in the second paragraph of Section 3.4;
- the decisions and reports from the notified body which are referred to in Section 3.4, last paragraph, Section 4.3 and Section 4.4.
6. Each notified body shall forward to the other notified bodies the relevant information concerning the quality system approvals issued and withdrawn.
Annex VIII
MODULE: INTERNAL CONTROL OF PRODUCTION
1. This module describes the procedure whereby the manufacturer or his authorized representative established within the Community, who carries out the obligations laid down in Section 2, ensures and declares that the equipment satisfies the requirements of the Directive applicable to it. The manufacturer or his authorized representative established within the Community shall affix the CE marking to each piece of equipment and draw up a written declaration of conformity.
2. The manufacturer shall establish the technical documentation described in Section 3 and he or his authorized representative established within the Community shall keep it at the disposal of the relevant national authorities for inspection purposes for a period ending at least 10 years after the last piece of equipment was manufactured.
Where neither the manufacturer nor his authorized representative is established within the Community, the obligation to keep the technical documentation available shall be the responsibility of the person who places the equipment on the Community market.
3. Technical documentation shall enable the conformity of the equipment with the relevant requirements of the Directive to be assessed. It shall, to the extent necessary for such assessment, cover the design, manufacture and operation of the product. It shall contain:
- a general description of the equipment,
- conceptual design and manufacturing drawings and schemes of components, sub-assemblies, circuits, etc.,
- descriptions and explanations necessary for the understanding of said drawings and schemes and the operation of the equipment,
- a list of the standards applied in full or in part, and descriptions of the solutions adopted to meet the safety aspects of the Directive where the standards have not been applied,
- results of design calculations made, examinations carried out, etc.,
- test reports.
4. The manufacturer or his authorized representative shall keep a copy of the declaration of conformity with the technical documentation.
5. The manufacturer shall take all measures necessary to ensure that the manufacturing process guarantees compliance of the manufactured equipment with the technical documentation referred to in Section 2 and with the requirements of the Directive applicable to such equipment.
Annex IX
MODULE: UNIT VERIFICATION
1. This module describes the procedure whereby the manufacturer ensures and declares that the equipment or protective system which has been issued with the certificate referred to in Section 2 conforms to the requirements of the Directive which are applicable to it. The manufacturer or his authorized representative in the Community shall affix the CE marking to the equipment or protective system and draw up a declaration of conformity.
2. The notified body shall examine the individual equipment or protective system and carry out the appropriate tests as set out in the relevant standard(s) referred to in Article 5, or equivalent tests, to ensure its conformity with the relevant requirements of the Directive.
The notified body shall affix, or cause to be affixed, its identification number on the approved equipment or protective system and shall draw up a certificate of conformity concerning the tests carried out.
3. The aim of the technical documentation is to enable conformity with the requirements of the Directive to be assessed and the design, manufacture and operation of the equipment or protective system to be understood.
The documentation shall contain:
- a general description of the product;
- conceptual design and manufacturing drawings and layouts of components, sub-assemblies, circuits, etc.;
- descriptions and explanations necessary for the understanding of said drawings and layouts and the operation of the equipment or protective system;
- a list of the standards referred to in Article 5, applied in full or in part, and descriptions of the solutions adopted to meet the essential requirements of the Directive where the standards referred to in Article 5 have not been applied;
- results of design calculations made, examinations carried out, etc.;
- test reports.
Annex X
A. CE Marking
The CE conformity marking shall consist of the initials "CE" taking the following form:
If the marking is reduced or enlarged, the proportions given in the above graduated drawing must be respected <*>.
The various components of the CE marking must have substantially the same vertical dimension, which may not be less than 5 mm.
This minimum dimension may be waived for small-scale equipment, protective systems or devices referred to in Article 1 (2).
B. Content of the EC declaration of conformity
The EC declaration of conformity must contain the following elements:
- the name or identification mark and the address of the manufacturer or his authorized representative established within the Community;
- a description of the equipment, protective system, or device referred to in Article 1 (2);
- all relevant provisions fulfilled by the equipment, protective system, or device referred to in Article 1 (2);
- where appropriate, the name, identification number and address of the notified body and the number of the EC-type-examination certificate;
- where appropriate, reference to the harmonized standards;
- where appropriate, the standards and technical specifications which have been used;
- where appropriate, references to other Community Directives which have been applied;
- identification of the signatory who has been empowered to enter into commitments on behalf of the manufacturer or his authorized representative established within the Community.
Annex XI
MINIMUM CRITERIA TO BE TAKEN INTO ACCOUNT BY MEMBER
STATES FOR THE NOTIFICATION OF BODIES
1. The body, its director and the staff responsible for carrying out the verification tests shall not be the designer, manufacturer, supplier or installer of equipment, protective systems, or devices referred to in Article 1 (2) which they inspect, nor the authorized representative of any of these parties. They shall become involved neither directly nor as authorized representatives in the design, construction, marketing or maintenance of the equipment, protective systems or devices referred to in Article 1 (2) in question. This does not preclude the possibility of exchanges of technical information between the manufacturer and the body.
2. The body and its inspection staff shall carry out the verification tests with the highest degree of professional integrity and technical competence and shall be free from all pressures and inducements, particularly financial, which may influence their judgement or the results of the inspection, especially from persons or groups of persons with an interest in the result of verifications.
3. The body shall have at its disposal the necessary staff and possess the necessary facilities to enable it to perform properly the administrative and technical tasks connected with verification; it shall also have access to the equipment required for special verification.
4. The staff responsible for inspection shall have:
- sound technical and professional training;
- satisfactory knowledge of the requirements of the tests which they carry out and adequate experience of such tests;
- the ability to draw up the certificates, records and reports required to authenticate the performance of the tests.
5. The impartiality of inspection staff shall be guaranteed. Their remuneration shall not depend on the number of tests carried out or on the results of such tests.
6. The body shall take out liability insurance unless its liability is assumed by the State in accordance with national law or the Member State itself is directly responsible for the tests.
7. The staff of the body shall be bound to observe professional secrecy with regard to all information gained in carrying out its tasks (except the competent administrative authorities of the State in which its activities are carried out) under this Directive or any provision of national law giving effect to it.
